libano), lungo il litorale tra S. Giovanni d'Acri e Giubbet Bisharrl e nella Galilea
testimoniano del contributo dell'Italia al progresso del Libano.
Per questi ricordi del passato e per i concreti comuni interessi del presente il trattato di amicizia, navigazione e commercio fra 1'Italia ed il Libano e stato
accolto con grande soddisfazione negli ambienti italiani e l'eco di questa soddi
sfazione si b avuta nella stampa. Lo stesso puo dirsi del Libano i cui giornali hanno
salutato con grande simpatia il riallacciamento dei rapporti con l'ltalia in forma
ufficiale.
In altri tempi l'ltalia faceva sentire nel Libano la voce della sua cultura
scientifica e artistica. Ci auguriamo che in un prossimo avvenire anche i rapporti culturali fra i due Paesi possano riprendere e intensificarsi, tan to piu che mai, nep
pure durante la guerra, si b spento in Italia l'interesse per gli studi delle civilta
del Vicino Oriente; ne, d'altra parte, il Libano puo dimenticare che l'ltalia b sempre stata un centro di vita artistica e culturale che affonda le sue radici in quella civilta
mediterranea alia quale anche il Libano ha dato il suo contributo.

La deliberazione della Grande Assemblea delle Nazioni Unite relativa alia isti . tuzione di ana Commissione di Conci liazione per la Palestina (11 dicembre
1948). Riportiamo da Palestine Affairs di dicembre
1948 il testo della deliberazione approvata V11 di
cembre 1948 per Vistituzione di una Commis
sione di Conciliazione per la Palestina.
THE GENERAL ASSEMBLY,
Having considered further the situation
in Palestine,
1. Expresses its deep appreciation of the
progress achieved through the good offices of
the late United Nations Mediator in promoting a peaceful adjustment of the future situation in
Palestine for which cause he sacrificed his life; and
Extends its thanks to the Acting Mediator and his staff for their continued efforts and
devotion to duty in Palestine.
2. Establishes a Conciliation Commission
, consisting of three States Members of the
United Nations which shall have the following functions:
a) To assume, in so far as it considers
necessary in existing circumstances, functions
given to the United Nations Mediator on Pale
stine by the resolution of the General Assembly of 14 April, 1948;
b) To carry out the specific functions
and directives as may be given to it by the
General Assembly or by the Security Council;
c) To undertake, upon request of the
Security Council, any of the functions now
assigned to the United Nations Mediator on
Palestine or to the United Nations Truce Com
mission by resolutions of the Security Council;
upon such request to the Conciliation Commis
sion by the Security Council with respect to
all the remaining functions of the United Nations
Mediator on Palestine under Security Council
resolutions, the office of Mediator shall be
terminated.

3- A Committee of the Assembly consisting of the representatives of China, France, Union
of Soviet Socialist Republics, United Kingdom and United States of America shall present for approval of the Assembly a proposal concern
ing the names of three States who will con
stitute the Conciliation Commission.
4. Requests the Commission to begin its
functions at once, with a view to the establish
ment of contact between the Parties themselves
and the Commission at the earliest possible date.
5. Calls upon the Governments and autho
rities concerned to extend the scope of the
negotiations provided for in the Security Coun
cil's Resolution of November 16, 1948 and
to seek agreement by negotiations conducted
either with the Conciliation Commission or
directly with a view to final settlement of all
questions outstanding between them.
6. Instructs the Conciliation Commission
to take steps to assist the Governments and
authorities concerned to achieve a final settle
ment of all questions outstanding between
them.
7. Resolves that Holy Places, including Na
zareth, religious buildings and sites in Palestine
should be protected and free access to them as
sured, in accordance with existing rights and his
torical practice; that arrangements to this end
should be under effective United Nations supervi
sion; that the United Nations Conciliation Com
mission in presenting to the fourth regular session
of the General Assembly its detailed proposal for
a permanent international regime for the terri
tory of Jerusalem should include recommenda
tions concerning the Holy Places in that terri
tory; that with regard to the Holy Places in the
rest of Palestine the Commission should call
upon the political authorities of the areas con
cerned to give appropriate formal guarantees to the protection of the Holy Places and access
to them; and that these undertakings should be
presented to the General Assembly for approval.
8. Resolves that in view of its association
with three world religions, the Jerusalem area,
including the present municipality of Jerusalem,
plus surrounding, villages and towns, most
eastern of which shall be Abu Dis; most southern
Bethlehem; most western Ein Karem (includ
ing also the built-up area of Motsa); and most
northern Shufat, should be accorded special
and separate treatment from the rest of Palestine
and should be placed under effective United
Nations control.
Requests the Security Council to take
further steps to ensure the demilitarization of
Jerusalem at the earliest possible date.
Instructs the Conciliation Commission
to present to the fourth regular session of the
General Assembly detailed proposals for a
permanent international regime for Jerusalem area which will provide for maximum local
autonomy for distinctive groups consistent with
the special international status of the Jerusalem area.
The Conciliation Commission is authorized
to appoint United Nations representatives who
shall co-operate with the local authorities with
respect to the interim administration of the
Jerusalem area.
9. Resolves that, pending agreement on
more detailed arrangements among the Govern
ments and authorities concerned, the freest
possible access to Jerusalem by road, ,rail
or air should be accorded to all inhabitants of
Palestine.
Instructs the Conciliation Commission to
report immediately to the Security Council
for appropriate action by that organ any attempt
by any party to impede such access.
10. Instructs the Conciliation Commission
to seek arrangements among the Governments
and authorities concerned which will facilitate
the economic development of the area, includ
ing arrangements for access to ports and airfields
and use of transportation and communication
facilities.
11. Resolves that the refugees wishing to
return to their homes and live at peace with their
neighbours should be permitted to do so at the
earliest practicable date, and that compensation
should be paid for the property of those choos
ing not to return and for loss of or damage to
property which under principles of international
law or in equity should be made good by the Governments or authorities responsible.
Instructs the Conciliation Commission to
facilitate the repatriation, resettlement and
economic and social rehabilitation of the refu
gees and the payment of compensation and to
maintain close relations with the Director of

the United Nations Relief for Palestine Refugees,
and through him with the appropriate organs
and agencies of the United Nations.
12. Authorises the Conciliation Commission
to appoint such subsidiary bodies and to employ such technical experts, acting under its autho
rity, as it may find necessary to the effective
discharge of its functions and responsibilities
under the present resolution.
The Conciliation Commission will have its
official headquarters at Jerusalem. Authorities
responsible for maintaining order in Jerusalem will be responsible for taking all measures
necessary to ensure the security of the Com
mission. The Secretary-General will provide a
limited number of guards for the protection of the staff and premises of the Commission.
13. Instructs the Conciliation Commission
to render progress reports periodically to the Se
cretary-General for transmission to the Security Council and to Members of the United Nations.
14. Calls upon all Governments and autho
rities concerned to co-operate with the Conci
liation Commission and to take all possible
steps to assist in the implementation of this
resolution.
15. Requests the Secretary-General to pro vide the necessary staff and facilities and to
make appropriate arrangements to provide the
necessary funds required in carrying out terms
of the present resolution.

15 febbraio 1949; ? Esaminati i risultati del lavoro scientifico
italiano in Africa nei campo giuridico e parti colarmente in quello degli studi di diritto mu sulmanoe deidiritti consuetudinari locali, nuova
prova delle vigenti tradizioni di spirito uma
nistico degli studi italiani, e ri leva to che a tale elaborazione scientifica ha corrisposto nei 70 anni
di attivita africana dell'Italia la elaborazione
di norme di diritto che, riconoscendo gia anche
al di la. dei tempi nei quali furono emanati una
partecipazione degli organismi etnici e religiosi locali all'amministrazione del territorio, hanno
favorito lo sviluppo di quelle popolazioni nella loro evoluzione civile;
? Convinto che la nuova fase dell'attivita
degli Stati nei continente africano dev'essere
diretta a portare quei popoli alle piu alte forme di ordinamento politico fino alia totale indi
pendenza, e che questo scopo debba condizio
nare l'azione di tutte le amministrazioni fidu
ciarie;
?Considerato che tale nobilissimo ed essen
ziale fine nei sistema della Carta di S. Fran
cisco si integra con gli interessi della pace gene
rale, cui il Continente africano contribuira con
l'evoluzione politica dei suoi popoli e con la
valorizzazione delle sue immense risorse eco
nomiche che non e possibile se non in un gene rale regime di larga collaborazione interna
zionale;
? Ritiene che l'ltalia, per il contributo gia dato dalla sua scienza e dal suo lavoro e per
quello che ragioni geografiche, storiche ed eco
nomiche la pongono in grado di dare ancor
piu in avvenire, debba partecipare in pieno al
l'opera che sotto il controllo delle Nazioni Unite
si deve compiere nei continente africano; e
segnatamente
AUSPICA
? che, nelle forme piu adatte alia nuova fase
politica africana, sia scelta l'ltalia a guidare le
popolazioni dei suoi antichi territori verso il
loro nuovo e piu alto destino ?.
