In conformità alle regole già attuate in altri PaesiEuropei, la classificazione degli alberghi vienericonosciuta dal Comune competente per territorio ed èespressa con un numero di stelle (da 1 a 5), tanto piùalto quanto più elevata è la categoria.

I prezzi degli alberghi si riferiscono a camere conbagno, sono espressi in euro nella misura massima(max.) dichiarata dall’albergatore, e sono disposti sudue righe:- la prima in alto si riferisce alla bassa stagione (finoal 20 giugno e dal 1° settembre in poi);- la riga in basso all’alta stagione (dal 21 giugno al 31agosto, dal 20 dicembre al 7 gennaio e periodoPasquale in concomitanza con le vacanze scolasticheitaliane).

I prezzi di pensione completa si applicano per unapermanenza non inferiore a 3 giorni e si intendono perpersona.

Le controversie fra datore d’alloggio e ospite sonoregolamentate dalle norme vigenti (leggi, regolamenti,usi e consuetudini in materia di turismo).

Leggi, Decreti, Usi e Consuetudini in materia di turismo

Il prezzo alberghiero- L’albergatore ha facoltà di diversificare il prezzoa suo criterio, entro il massimo denunciato. (L.284 del 25/8/91 e L.R. 16/2004).- I prezzi devono essere esposti nel locale adibitoal servizio di ricevimento e nelle camere suappositi cartellini (Decreto M.T. 16/10/91 e L.R.16/2004).- Il prezzo di pensione completa per personaviene praticato per un soggiorno che raggiunga ilminimo di tre giorni di permanenza continua inalbergo. Può essere applicato il prezzo alla cartadei servizi prestati per un soggiorno inferiore ai 3giorni. (RDL 2049/1935).

La prenotazione- La legge italiana non disciplina espressamente il“contratto d’albergo”. Poiché la validità delcontratto è data dal consenso delle particontraenti, ciò può avvenire sia in forma oraleche in forma scritta. L’assenza di unadocumentazione può determinare tuttaviadifficoltà di soluzione ad eventuali controversie, èquindi consigliabile che la prenotazione avvengaper iscritto e per iscritto confermata (RaccoltaProvinciale Usi).- All’arrivo in albergo, sistemazioni ocaratteristiche alberghiere non conformi allaprenotazione, se accettate dal turista, annullanoogni precedente accordo. Se non accettate,danno diritto alla sistemazione in altro albergo dipari categoria o di categoria superiore. In caso didisparità di prezzo, l’albergatore è tenuto alpagamento della differenza. (RaccoltaProvinciale Usi).

La caparra- Se il cliente rinuncia al soggiorno per cui avevaanticipato una caparra, l’albergatore può ritenerlaa scopo d’indennizzo.- Se l’inadempiente è l’albergatore, il cliente hadiritto al raddoppio di caparra. (C.C. artt. 1385,1386).

La partenza anticipata- La partenza anticipata rispetto al periodoprenotato può comportare l’applicazione di unapenale fino ad un massimo di tre volte il prezzo dicamera (Raccolta Provinciale Usi).

La responsabilità dell’albergatore- La responsabilità dell’albergatore per furti odanneggiamenti di oggetti di proprietà dei clientiè prevista in apposite disposizioni di legge (C.C.artt. 1783, 1784, 1785, 1786).

In line with the regulations already in force in otherEuropean countries, hotel classification is expressedby a star rating system (from 1 to 5), which has beenrecognised by the competent local Municipality andin which the greater the number of stars, the higherthe category.

The hotel prices refer to rooms with en-suitebathroom. They are on two lines and are expressedin euro at the maximum rate (max.) declared by thehotelier:- the first line refers to low season (until 20th Juneand from 1st September onwards);- the second line refers to high season (from 21st

June until 31st August, from 20th December until 7th

January and the Easter period, in concomitance withItalian school holidays).

Full-board prices are valid for stays of not less than3 nights and are intended as per person.

Prices are inclusive of V. A. T. (Value Added Tax).

Prices do not include drinks or any additionalservices.

The data contained in this yearbook is based on 2013price declarations, which were submitted by eachindividual operator to the Province of Rimini by 1st

October 2012, and on the information supplied bythe Municipalities.

Prices quoted may be subject to variations from01.06.2013 onwards.

Any claims concerning correct price applications andaccommodation can be presented to the I.A.T.(Tourist Information) Offices of the Province ofRimini, who will be pleased to assist in such mattersand will undertake to forward the relevantcomplaints to the bodies concerned.

Disputes between hoteliers and guests are regulatedby the current provisions in force (laws, regulations,uses and practices in the tourism sector).

Laws, Decrees, Uses and Practices in the Tourism Sector

Hotel prices- Hoteliers reserve the right to determineroom charges providing they fall within thedeclared maximum rate (Law no. 284 of25/8/91 and Regional Law 16/2004).- Prices must be clearly stated on specialdisplay cards both in the hotel reception andin rooms (M.T. Decree 16/10/91 and RegionalLaw 16/2004).- Full-board prices per person are applicablefor continuous stays of a minimum of threenights at the same hotel. Different prices maybe applied for services provided for guestsstaying less than three nights. (RDL no.2049/1935).

Bookings- Italian law does not expressly regulate “hotelcontracts”. The validity of a contract is basedon the consensus of the two parties involved,which may be agreed either verbally or inwriting. As the absence of any documentationmakes it difficult to resolve disputes, it isadvisable to ensure that both bookings andconfirmations are made in writing (UsiProvincial Archive).- On arrival at the hotel, tourists who find thateither the accommodation arrangements orhotel features do not conform to the bookingmade, may choose to accept them, yet bydoing so, effectively annul any previousagreements made. If, however, they do notaccept them, they have the right to beprovided with accommodation in another hotelin the same category or in a superiorcategory. The hotelier will be held responsiblefor settling any differences in price. (UsiProvincial Archive).

Deposits- Advance deposits paid by clients whosubsequently cancel bookings may be retainedby the hotelier as compensation.If the hotelier cancels the client’s reservation,the client has the right to claim back doublethe deposit paid. (Civil Code paragraphs 1385and 1386).

Early departures- If clients depart earlier than the foreseendate, they may be required to pay a penalty ofup to a maximum of three times the roomprice (Usi Provincial Archive).

Hoteliers’ responsibilities- The hotelier’s responsibility for the theft of,or damage to, the property of clients isoutlined in special legal provisions (Civil Codeparagraphs 1783, 1784, 1785 and 1786).

Die Hotelpreise beziehen sich auf ein Zimmer mit Bad.Es sind vom Hotelier angegebene, in Euro formulierteMaximalpreise (max.); angeordnet in zwei Zeilen:- die erste oben bezieht sich auf die Vor- undNachsaison (bis zum 20. Juni und ab dem 1.September);- die untere auf die Hauptsaison (vom 21. Juni biszum 31. August, vom 20. Dezember bis zum 7. Januar,die Osterzeit in Übereinstimmung mit den italienischenSchulferien).

Die Vollpensionspreise verstehen sich für einenAufenthalt von mindestens drei Tagen pro Person.

Die Mehrwertsteuer (I.V.A.) ist im Preis inbegriffen.

Nicht inbegriffen sind Getränke und zusätzlicheServiceleistungen.

Die im vorliegenden Hotelverzeichnis angegebenenDaten wurden den Meldungen der einzelnen Hotels fürdas Jahr 2013, die bis zum 1.Oktober 2012 bei derProvinz von Rimini eingereicht worden sind, und denInformationen seitens der Gemeinden entnommen.

Die Preise können ab dem 01.06.2013 geändert werden.

Evtl. Beschwerden wegen nicht korrekter Preise odereiner mangelhaften Beherbergung können in einem derI.A.T. Büros (Touristeninformation und -aufnahme) derProvinz Rimini eingereicht werden. Hier erhalten SieBeistand und Ihre Beschwerde wird ggf. an diezuständige Behörde weitergeleitet.

Streitfälle zwischen Hotel und Gast werden nach dengeltenden Bestimmungen geregelt (Gesetze,Vorschriften, Gebräuche und Gewohnheiten imTourismusbereich).

Gesetze, Dekrete, Gebräuche undGewohnheiten im Tourismusbereich

Der Hotelpreis- Das Hotel ist berechtigt, den Preis bis hin zumangegebenen Maximum nach seinen Kriterien zuvariieren (Gesetz Nr. 284 vom 25.8.91 undRegionalgesetz 16/2004).- Die Preise müssen im Empfangsbereich und inden Zimmern auf dafür vorgesehenen Tafelnausgehängt werden (Dekret M.T. 16.10.91 undRegionalgesetz 16/2004).- Der Vollpensionspreis pro Person gilt bei einemAufenthalt von mindestens drei aufeinanderfolgenden Tagen. Bei einem Aufenthalt vonweniger als drei Tagen kann ein Preis auf Basisder Preisliste für den erbrachten Service verlangtwerden (RDL Nr. 2049/1935).

Die Buchung- Der “Beherbergungsvertrag” wird vomitalienischen Gesetz nicht ausdrücklich geregelt.Weil die Gültigkeit des Vertrages durch denKonsens der Vertragsparteien gegeben ist, kanndies sowohl in mündlicher wie in schriftlicher Formgeschehen. Dennoch kann das Fehlen einerDokumentation Schwierigkeiten für die Lösung evtl.Kontroversen bewirken; deshalb ist es ratsam, dassdie Buchung schriftlich erfolgt und schriftlichbestätigt wird (Provinz-Sammlung der Gebräuche).- Wenn bei der Ankunft im Hotel die Unterbringungoder andere Beherbergungsmerkmale, die nichtder Buchung entsprechen, vom Touristenakzeptiert werden, annullieren sie jedevorhergehende Vereinbarung. Falls sie nichtakzeptiert werden, ergibt sich das Recht aufUnterbringung in einem anderen Haus gleicheroder höherer Kategorie. Bei unterschiedlichemPreis ist das Hotel gehalten, die Differenz zuzahlen (Provinz-Sammlung der Gebräuche).

Die Anzahlung- Wenn der Kunde den Aufenthalt, für den er eineAnzahlung geleistet hat, nicht antritt, kann dasHotel sie als Entschädigung einbehalten.- Hält das Hotel sich hingegen nicht an denVertrag, hat der Kunde Anrecht auf eineVerdopplung dieser Anzahlung (BürgerlichesGesetzbuch Art. 1385, 1386).

Vorzeitige Abreise- Eine Abreise vor dem Ende des gebuchtenZeitraums kann zur Anwendung einer Strafeführen, die maximal den dreifachen Zimmerpreisausmachen darf (Provinz-Sammlung derGebräuche).

Die Verantwortung des Hotels- Die Verantwortung des Hotels bei Diebstählenoder Beschädigungen am Eigentum der Kundenist in eigenen Gesetzen geregelt (BürgerlichesGesetzbuch Art. 1783, 1784, 1785, 1786).

Conformément aux règles appliquées dans d’autres payseuropéens, la classification des hôtels est approuvée parla Mairie compétente pour chaque territoire et estexprimée par un nombre d’étoiles (de 1 à 5) d’autantplus élevé que l’est la catégorie.

Les prix des hôtels se réfèrent à des chambres avecsalle de bains et correspondent aux tarifs maximaux(max.) déclarés par l’hôtelier; ils sont exprimés en euroset placés sur deux lignes:- la ligne supérieure concerne la basse saison(jusqu’au 20 juin et à partir du 1er septembre);- la ligne inférieure se rapporte à la pleine saison (du21 juin au 31 août, du 20 décembre au 7 janvier et lapériode de Pâques coïncidant avec les vacancesscolaires italiennes).

Les tarifs de pension complète sont applicables pour unséjour minimum de 3 jours et s’entendent par personne.

La T.V.A. (Taxe sur la valeur ajoutée) est comprise dansle prix.

Les prix ne comprennent ni les boissons ni les servicesextra.

Les données contenues dans le présent annuaire sonttirées des déclarations officielles des prix pour l’année2013, présentées par chaque hôtelier au bureaucompétent de la Province de Rimini avant le 1er octobre2012, ainsi que des renseignements fournis par lesMairies.

Les prix indiqués sont susceptibles de modifications àpartir du 01.06.2013.

Toute réclamation concernant l’application correcte destarifs ainsi que la structure hôtelière peut être présentéeà l’un des bureaux I.A.T. (Information et AccueilTouristique) de la Province de Rimini, ceux-cipourvoyant à l’assistance touristique et au suivi de cesmêmes éventuelles réclamations.

Tout litige entre hôtelier et client sera régi par lesnormes de la loi en vigueur (lois, règlements, us etcoutumes en matière de tourisme).

Le tarif hôtelier- L’hôtelier a la faculté de diversifier le prix selonson jugement, dans les limites des tarifsmaximaux déclarés (L. n° 284 du 25/8/91 et L.R.16/2004).- Les prix doivent être exposés dans le localaccueillant le service de réception et dans leschambres sur des fiches prévues à cet effet(Décret M.T. 16/10/91 et L.R. 16/2004).- Le prix de pension complète par personne estappliqué pour un séjour minimal de trois joursconsécutifs auprès de l’hôtel. Pour un séjourinférieur à trois jours, le prix “à la carte” desservices fournis peut être appliqué (RDL n.2049/1935).

La réservation- La loi italienne ne réglemente pas expressémentle “contrat d’hôtel”. La validité du contrat étantdonnée par le consentement des partiescontractantes, celui-ci peut être établi tant sousforme orale que sous forme écrite. L’absence dedocumentation pouvant toutefois déterminer desdifficultés de solution à tout éventuel litige, laréservation effectuée par écrit et confirmée parécrit est donc conseillable (Recueil Provinciald’Usages).- A l’arrivée à l’hôtel, les hébergements ou lescaractéristiques hôtelières non conformes à laréservation qui sont toutefois acceptés par letouriste annulent tout accord précédent. Dans lecas où ils ne soient pas acceptés, ils donnentdroit à un hébergement dans un autre hôtel demême catégorie ou de catégorie supérieure. Encas de disparité de prix, l’hôtelier est tenu aupaiement de la différence (Recueil Provinciald’Usages).

Les arrhes- Si le client renonce au séjour pour lequel il avaitversé des arrhes, l’hôtelier peut les garder à titred’indemnisation.En cas de défaillance de la part de l’hôtelier, leclient a droit au double du montant d’arrhes versé(C.C. articles 1385 et 1386).

Le départ anticipé- Le départ anticipé par rapport à la périoderéservée peut comporter l’application d’unepénalité pouvant s’élever à un maximum de troisfois le prix de la chambre (Recueil Provinciald’Usages).

La responsabilité de l’hôtelier- La responsabilité de l’hôtelier en cas de vols oude dommages d’objets appartenant aux clientsest régie par les dispositions de la loi prévues àcet effet (C.C. articles 1783, 1784, 1785 et 1786).

Los números entre paréntesis al lado del nombre delhotel se refieren al número de las habitaciones (C.), delas camas (L.) y de los cuartos de baño (B.).

De conformidad con la normativa vigente en otrospaíses europeos, la clasificación de los hoteles esreconocida por el ayuntamiento de competencia para elterritorio y se expresa por medio de un número deestrellas (de 1 a 5), que es mayor o menor en función dela categoría de los mismos.

Los precios de los hoteles se refieren a habitacionescon cuarto de baño, se expresan en euros indicando elvalor máximo declarado por el hotelero y estándispuestos en dos columnas:- la primera de arriba se refiere a la temporada baja(hasta el 20 de junio y a partir del 1 de septiembre);- la de abajo significa temporada alta (del 21 de junioal 31 de agosto y del 20 de diciembre al 7 de enero ySemana Santa-Pascua en coincidencia con lasvacaciones escolares italianas).

Los precios de la pensión completa se aplican por unaestancia no inferior a tres (3) días y se entienden porpersona.

El IVA (Impuesto sobre el Valor Añadido) estácomprendido en el precio.

Los precios no comprenden las bebidas y los serviciosextra.

Los datos contenidos en el presente anuario procedende las declaraciones de los precios para 2013presentadas por cada operador a la DiputaciónProvincial de Rímini dentro del plazo del 1 de octubre de2012 y de las informaciones facilitadas por losayuntamientos.

Los precios indicados pueden sufrir variaciones a partirdel 01.06.2013.

Las eventuales reclamaciones, relativas a la correctaaplicación de los precios y a la estructura receptiva,pueden ser presentadas en las oficinas I.A.T. -Informaciones y Acogida Turística, situadas dentro de laprovincia de Rímini, que facilitan su propia asistencia yse encargan del eventual envío a los organismos decompetencia.

Las controversias entre quien proporciona elalojamiento y el cliente se regulan a tenor de las normasvigentes (leyes, reglamentos y usos y costumbres entema de turismo).

Leyes, decretos, usos y costumbres entema de turismo

Precio del hotel- El hotelero tiene la facultad para diversificar elprecio según su propio criterio, dentro delmínimo o el máximo denunciado (Ley n. 284 de25.8.91 y Ley Regional 16/2004).- Los precios deben estar expuestos en el localdestinado al servicio de recepción y en lashabitaciones con letreros apropiados (Decretodel Ministerio de Turismo italiano de 16.10.91 yLey Regional 16/2004).- El precio de la pensión completa por personase aplica para una estancia que cubra un mínimode tres (3) días de permanencia continua en elhotel. Se puede aplicar el precio a la carta porlos servicios prestados en una estancia inferior atres (3) días. (Real Decreto Ley n. 2049/1935).

Reserva- La ley italiana no disciplina expresamente el“contrato de hotel”. Puesto que la validez delcontrato es dada por el consenso de las partescontrayentes, dicho consenso puede producirsetanto de palabra como por escrito. La ausenciade una documentación puede dar lugar, noobstante, a dificultades en la solución deeventuales controversias y por ello se aconsejaque la reserva se haga por escrito y se confirmepor escrito (Repertorio Provincial de Usos). - A la llegada al hotel, el alojamiento o lascaracterísticas hoteleras que no sean conformescon la reserva, si se aceptan por parte del turista,anulan todo acuerdo anterior. De no aceptarse,dan derecho a alojamiento en otro hotel de igualcategoría o de categoría superior. En caso deprecio diferente, el hotelero tiene la obligación depagar la diferencia (Repertorio Provincial de Usos).

Paga y señal- Si el cliente renuncia a la estancia por la quehabía anticipado una paga y señal, el hoteleropuede considerarla como una indemnización. - Si el incumplimiento es del hotelero, el clientetiene derecho a percibir el doble de la paga yseñal (artículos 1385 y 1386 del Código Civilitaliano).

Salida anticipada- La salida anticipada respecto al períodoreservado puede comportar la aplicación de unapenalización de hasta un máximo de tres veces elprecio de la habitación (Repertorio Provincial deUsos).

Responsabilidad del hotelero- La responsabilidad del hotelero por robo o dañoa los objetos de propiedad de los clientes estáprevista por las oportunas disposiciones de ley(artículos 1783, 1784, 1785 y 1786 del Código Civilitaliano).

Informaciones de carácter general

В соответствии с уже принятыми правилами вдругих европейских странах, классификациягостиниц определяется органами того города натерритории которого находится гостиница, ивыражается количеством звёзд (от 1 до 5): чембольше звёзд, тем выше категория.

Указанные цены на номера с ванными комнатамивыражены в евро в максимальном размере (макс.), заявленном администрацией гостиницы, и расположены на двух строках:- верхняя строка обозначает мёртвый сезон(до 20 июня, и с 1 сентября и далее)- нижняя строка обозначает разгартуристического сезона (с 21 июня по 31 августа, с 20 декабря по 7 января, а также Пасха во времяшкольных каникул в Италии).

Цены за полный пансион подразумеваютпроживание одного человека не менее 3 дней.

НДС (налог на добавленную стоимость)включён в цену.

В цены не включены напитки и дополнительныеуслуги.

Указанные в данном ежегоднике цены получены иззаявленных организациями цен на 2013 год вАдминистрацию провинции Римини до 1 октября2012 года, а также информации, предоставленнойгородскими управлениями.

Указанные цены могут быть изменены с01.06.2013 года.

Претензии по правильности применения цен и попринимающей структуре могут быть выставлены влюбое из отделений IAT (Информация иразмещение туристов), расположенных натерритории провинции Римини, которыепредоставляют помощь в данных вопросах и, принеобходимости, делают заявления в компетентныеорганы.Разногласия между предоставляющей жильёструктурой и гостем регулируются действующимиправилами (законы, регламенты, правила и нормыв области туризма).

Законы, декреты, правила и нормы в облаституризма

Цена гостиницы- Администрация гостиницы имеет право изменитьцену по своему усмотрению до размера заявленногомаксимума (Закон № 284 от 25/8/91 и областнойзакон № 16/2004).

- Цены должны быть выставлены впредназначенном для приема гостейпомещении, а также в номерах, наспециальных табличках (Указ Мин.Туризма от 16/10/91 и областной закон №16/2004).- Цена за полный пансион на человекаприменяется в случае непрерывногопроживания в гостинице в течение трёх сутокминимум. За редоставленные услуги припроживании менее трёх суток могутприменяться цены из прейскуранта(Королевский указ 2049/1935).

Бронирование- В итальянском законодательстве нет чёткогорегламента по «гостиничному контракту». Таккак действительность контракта обусловленасогласием договаривающихся сторон,согласие может быть выражено как в устной,так и в письменной форме. Тем не менее,отсутствие документации может затруднитьрешение возможных разногласий,следовательно, рекомендуется бронировать иподтверждать бронирование гостиницы вписьменной форме (Сборник правилпровинции).- При прибытии в гостиницу, еслиразмещение и характеристики гостиницы несоответствуют забронированным, но былиприняты туристом, то это аннулирует любоепредыдущее соглашение. Если они непринимаются, то это даёт право наразмещение в другой гостинице равной иливысшей категории.В случае разницы в цене администрациягостиницы обязана оплатить разницу(Сборник правил провинции).

Аванс- Если клиент отказывается отпребывания, за которое был внесен аванс, то администрация может удержать его вкачестве возмещение ущерба.- Если же свои обязательства невыполнила администрация гостиницы, токлиент имеет право на возмещение авансав двойном размере (Г.К., ст. 1385, 1386)

Преждевременный выезд- Преждевременный выезд относительнозаказанного периода может повлечь штраф вразмере максимум трёх стоимостей номера(Сборник правил провинции).

Ответственность администрациигостиницы- Ответственность администрации закражи или повреждения принадлежащихклиентам предметов предусмотренаспециальными требованиями закона(Г.К. ст. 1783, 1784, 1785, 1786).
