    ,

Good morning. I am checking in with you regarding 2 SC matters:

    1. 2pm Meeting with . advised to check with you to confirm whether we are still meetingwith today at 2pm regarding all-things SC. Assuming we are still on, is there anything you

need in advance of the meeting? Do you wish to pre-meet at an earlier time?

    2. Cook County. This is just an early FYI. SC has been trying to activate Cook County for abt 6months. Last week, , SCs Deployment Chief, contacted me regarding SCs

current efforts. While the facts are not yet fully known, it appears that

has beencommunicating with the State Information Bureaus attorney explaining the background ofinteroperability (fed info-sharing process) and informed me that he has sent the attorney theattached 2008 MOU bet ICE, DHS US-VISIT, DoS, and FBI CJIS that set forth the exchange ofinfo between the agencies from the IDENT/IAFIS interoperability. indicated that the attorneywishes to speak with ICE counsel and has provided the attorney my phone number. Beforeshe left for vacation, I informed abt the Cook County issue and she indicated she had no

issue with speaking with the state information bureau attorney

I plan on speaking with at 10am to get the facts and to explain to him that while I amavailable to speak to the attorney, I cannot give assurances on behalf of the agency, i.e ICEs

established legal position on issues such as whether SC can force the state to participate (10th

Am. Issue discussed in Opt out memo). This may turn out to be a mole-hill instead of amountain and just be a case of identifying for the attorney the FBIs authority to share info withICE (28 USC 534, IDENT SORN, FBIs related SORN) and citing various appropriation act whereCongress wanted this info-sharing ability be made available to local law enforcement (e.g. S.Rep.108-280 from 2004).

I will keep you informed of any new info on this issue after speaking with ..

    Thank you.
