    CONSIDERING tha t , on the bas i s o f the mate r i a l provided by the Prosecut ion insupport of the Prosecut ion 's Appl icat ion, there i s no os tens ible cause or se l f-evidentfactor to impel the Chamber to exercise i ts discretion under art icle 19(1) of the Statuteto determine at this stage the admissibil i ty of the case against Omar Al Bashir;^2

    CONSIDERING that there are reasonable grounds to bel ieve: ( i ) that soon af ter theat tack on El Fasher a i rport in Apri l 2003, the Government of Sudan ("GoS") i ssued ageneral call for the mobilisation of the Janjaweed Mili t ia in response to the activi t iesof the SLM/A, the JEM and other armed opposi t ion groups in Darfur , and thereafterconducted, through GoS forces , including the Sudanese Armed Forces and thei rall ied Janjaweed Mili t ia, the Sudanese Police Force, the National Intell igence andSecuri ty Service (" the NISS") and the Humani tar ian Aid Commiss ion (" the HAC"), acounte r - insurgency campaign throughout the Darfur reg ion aga ins t the sa id a rmedopposi t ion groups; and ( i i ) that the counter- insurgency campaign cont inued unt i l thedate of the fi l ing of the Prosecution Application on 14 July 2008;CONSIDERING tha t the re a re reasonable grounds to be l i eve : ( i ) tha t a co recom ponen t of the GoS counte r - insurgency campaign w as the unlawful a t tack on tha tpart of the c ivi l ian populat ion of Darfur - belonging largely to the Fur , Masal i t andZaghawa groups - perceived by the GoS as being close to the SLM/A, the JEM andthe other armed groups opposing the GoS in the ongoing armed confl ic t in Darfur;and ( i i ) that vi l lages and towns targeted as part of the GoS's counter- insurgencycampaign were se lected on the bas is of thei r e thnic composi t ion and that towns andvi l lages inhabi ted by other t r ibes , as wel l as rebel locat ions , were bypassed in orderto a t tack towns and vi l lages known to be inhabi ted by civi l ians belonging to the Fur ,Masa l i t and Zaghawa e thnic groups ;

    CONSIDERING tha t the re a re reasonable grounds to be l i eve tha t the a t t acks andacts of violence commit ted by GoS agains t a part of the Fur , Masal i t and Zaghawa12 As found by the Cha mb er in the F irst Decision, see ICC-02/05-01/09-3, para . 51, and reiterated in theSecond Decision, para. 41.N o .     CONSIDERING tha t the re a re reasonable grounds to be l i eve tha t , a s par t o f theGoS's unlawful a t tack on the above-ment ioned part of the c ivi l ian populat ion ofDarfur and wi th knowledge of such at tack, GoS forces subjected, throughout theDarfur region, thousands of c ivi l ians , belonging primari ly to the Fur , Masal i t andZaghawa groups , to acts of murder and exterminat ion;^3

    CONSIDERING that there are reasonable grounds to bel ieve, as wel l , that as part ofthe GoS's unlawful a t tack on the above-ment ioned part of the c ivi l ian populat ion ofDarfur and wi th knowledge of such at tack, GoS forces subjected, throughout theDarfur region, ( i ) thousands of c ivi l ian women, belonging primari ly to the Fur ,Masal i t and Zaghawa groups , to acts of rape; 4 () c ivi l ians belonging primari ly tothe Fur , Masal i t an d Za gh aw a gro up s , to acts of tor tu re ; ^ an d ( ii i) hu nd re ds ofthousands of c ivi l ians , belonging primari ly to the Fur , Masal i t and Zaghawa groups ,to acts of forcible transfer;i6

    CONSIDERING tha t tha t the re a re a l so reasonable grounds to be l i eve tha t i nfurtherance of the genocidal pol icy, as part of the GoS's unlawful a t tack on theabove-ment ioned part of the c ivi l ian populat ion of Darfur and wi th knowledge ofsuch at tack, GoS forces throughout the Darfur region ( i ) a t t imes , contamined thewel l s and wate r pumps o f the towns and v i l l ages pr imar i ly inhabi t ed by members o fthe Fur , Masal i t and Zaghawa groups that they at tacked; i7 ( i i ) subjected hundreds ofthousands o f c iv i l i ans be longing pr imar i ly to the Fur , Masa l i t and Zaghawa groupsto acts of forcible transfer;^^ and (i i i ) encouraged members of other tribes, which wereal l ied wi th the GoS, to reset t le in the vi l lages and lands previous ly mainly inhabi tedby members of the Fur , Masal i t and Zaghawa groups; i9

    CONSIDERING tha t , fo r t he above reasons , t he re a re r easonab le g rounds to be l ievethat Omar Al Bashir is c r iminal ly responsible as an indirec t perpe t ra tor , or as anindirect co-perpetrator, under art icle 25(3)(a) of the Statute, for:
