A recent survey by IACCM (InternationalAssociation for Contract & CommercialManagement, www.iaccm.com ) indicated thatthe average cost of poor contracting is 9.15%of an organization’s annual income – and evenhigher for large capital projects, up to 15% ofthe contract value. Accordingly, a EuropeanCommission study discovered that 65% ofmajor projects ‘fail’ or severely under-perform,with average cost overrun of 80%. Yet much ofthis failure can be eradicated throughimproved Contract Management andNegotiation and better commercial processand practices. Through our own experiences,IACCM have identified 10 critical “pitfalls” thatmost frequently lead to poor performance inservice contracts and the 10 negotiated termsand conditions (versus the most importanttones).
