Aplicarea legislatiei în domeniul concurentei

Investigaţii deschise

În semestrul 1 2012, Consiliul a deschis 17 investigaţii, din care 14 pentru posibile încălcări ale Legii concurenţei şi 3 anchete sectoriale. Investigaţiile de încălcare a legii concurenţei deschise prin autosesizare reprezintă 86% din total.

În funcţie de obiectul investigaţiei, cele 17 investigaţii sunt pentru:8 - analiza unor posibile înţelegeri anticoncurenţiale pe orizontală

(carteluri),2 - posibile abuzuri de poziţie dominantă, 1 -posibilă înţelegere anticoncurenţială pe verticală şi încălcare a legii

de către o instituţie a administraţiei publice,1 - cartel şi înţelegere verticală;2 - operaţiuni de concentrare economică (omisiune şi punerea în

practică înainte de notificare şi înainte de a fi declarată compatibilă cu un mediu concurenţial normal);3 - anchete sectoriale (cunoaştere a pieţei).

Investigaţii în curs

Sunt în desfăşurare 87 de investigaţii (70 din oficiu). Din total, 77 sunt pentru posibile încălcări şi 10 reprezintă anchete sectoriale. Distribuţia în funcţie de obiectul investigaţiei:

•73 sunt pentru posibile practici anticoncurenţiale (63 înţelegeri şi 10 abuzuri),

•2 pentru analiza unor concentrări economice, •2 pentru acte ale admistraţiei publice şi•10 anchete sectoriale.

Enforcement of the legislation on competition

New investigations

During the 1st Semester of 2012, the Competition Council has initiated 17 investigations, out of which 14 for possible infringements of the Competition Law and 3 sector inquiries. The ex-officio investigations envisaging possible infringements of the Competition Law represent 86% of the total number of procedures.

Considering the object of the investigations, the 17 procedures are envisaging:8 – analysis of certain anticompetitive horizontal agreements (cartels),2 – possible abuses of dominant position, 1 – possible vertical anticompetitive agreement and possible infringement

of the Competition Law by an institution of the public administration,1 - cartel and vertical agreement;2 – economic concentration operations (notification failure and putting

the operation into practice before notifying it and prior to a decision declaring it compatible with a normal competitive environment);3 – sector inquiries.

Investigations in progress

87 investigations (70 ex-officio procedures) were in progress at the end of June 2012. Out of their total number, 77 envisage possible infringements of the Competition Law and 10 are sector inquiries. Considering the object of the investigation:

•73 envisage possible anticompetitive practices (63 agreements and 10 abuses of dominant position),

•2 are focused on analysing certain economic concentrations, •2 envisage possible anticompetitive acts of the public administration and •10 sector inquiries.


În graficul nr. 1 este prezentată ponderea investigaţiilor, după obiectul investigaţiei.

Investigaţii finalizate

Au fost finalizate 10 investigaţii. După obiect, acestea sunt:4 carteluri,3 abuzuri de poziţie dominantă,1 înţelegere anticoncurenţială pe verticală,2 concentrări economice.

În primul semestru al anului 2012 au fost aplicate două sancţiuni pentru furnizarea de informaţii inexacte în cadrul investigaţiei desfăşurate pe piaţa lucrărilor de marcaje rutiere, atribuite de Compania Naţională de Autostrăzi şi Drumuri Naţionale din România (CNADNR) prin deschidere publică. Valoarea însumată a amenzilor aplicate este de 80.323 lei.

Inspecţii inopinate

Au fost organizate inspecţii inopinate în cadrul a 9 investigaţii, fiind controlate 95 sedii/puncte de lucru, aparţinând unui număr de 92 întreprinderi.

Finalized investigations

10 investigations have been concluded. Considering their object, they envisage:4 cartels,3 abuses of dominant position,1 vertical anticompetitive agreement,2 economic concentrations.

During the 1st Semester of 2012, two sanctions were applied for supplying inaccurate information within the investigation carried out on the market of road marking services assigned by the Romanian National Company of Highways and National Roads (CNADNR) through a tender procedure. The total value of the fines is of RON 80,323 lei.

Dawn raids

Dawn raids have been organised within 9 investigations, thereby being inspected 95 headquarters/working points belonging to 92 undertakings.

Decizii

Au fost emise 31 decizii, din care aproape jumătate pentru cazuri de concentrări economice (în scădere, totuşi, faţă de anul anterior). Aproape o treime sunt decizii de respingere a unor plângeri care acuzau practici anticoncurenţiale. Au fost emise şi două decizii de sancţiune a două societăţi care au furnizat autorităţii de concurenţă informaţii inexacte în cadrul unei investigaţii privind o înţelegere orizontală între participanţii la o achiziţie publică organizată de CNADNR.

Concurenţă neloială

Au fost înregistrate 67 cazuri, din care 54 au fost finalizate. Din cele 13 cazuri în derulare, 3 reprezintă cercetări aprofundate. Consiliul Concurenţei a respins 53 de plângeri privind încălcări ale Legii concurenţei neloiale şi a aplicat o amendă în valoare de 3.000 lei.

Promovarea regulilor de concurenţă

Activitatea Consiliului cu privire la promovarea regulilor de concurenţă în rândul instituţiilor/autorităţilor publice implicate în procesul de elaborare a actelor normative a constat în emiterea a 43 de avize, puncte de vedere şi opinii, după cum urmează:

Decisions

31 decisions have been issued, out of which almost half envisage economic concentrations (less than last year, however). Nearly one third of them are decisions for rejecting certain complaints on possible anticompetitive practices. Additionally, two sanctioning decisions have been issued in respect to two undertakings which have supplied inaccurate information within the investigation on a possible horizontal agreement concluded between the bidders within a public tender organized by CNADNR.

Unfair competition

67 cases have been initiated, out of which 54 have been concluded. Out of the 13 cases in progress at the end of June 2012, 3 represent thorough researches. The Competition Council has rejected 53 complaints on the possible infringement of the Law on Unfair Competition and has applied a fine of RON 3,000.

Competition advocacy

The activity of the Competition Council on promoting the competition rules within the institutions/public authorities involved in the process of elaborating normative acts resulted in the issue of 43 binding opinions, points of view and opinions, as follows:

Consiliul Concurentei - Autoritate nationala de contact în domeniul ajutorului de stat în raporturile dintre România si Comisia Europeana

Consiliul Concurenţei, în calitatea sa de autoritate de contact în raporturile cu Comisia Europeană, asigură aplicarea şi respectarea, de către autorităţile publice şi de mediul privat, a regulilor în domeniul ajutorului de stat, precum şi o comunicare eficientă cu forul comunitar.

Acordarea de consultanţă în domeniul ajutorului de stat

Experţii Consiliului Concurenţei au participat la un număr de 70 de reuniuni de lucru şi consultări tehnice (inclusiv video-conferinţe) şi au emis un număr de 179 de opinii scrise (clarificări) privind respectarea regulilor în domeniul ajutorului de stat. Acestea au avut ca obiectiv: pregătirea notificărilor unor măsuri de sprijin financiar la Comisia Europeană, clarificarea unor cazuri aflate în discuţie cu oficialii comunitari, elaborarea unor acte normative cu incidenţă în domeniul ajutorului de stat, implementarea schemelor de ajutor de stat etc.Astfel, în cursul semestrului I al anului 2012, Consiliul Concurenţei a acordat consultanţă de specialitate autorităţilor publice centrale şi locale în vederea elaborării a 28 de proiecte de acte normative/administrative.

Răspunsuri şi formulări de poziţii în domeniul ajutorului de stat în vederea transmiterii la Comisia Europeană

Consiliul Concurenţei a acordat consultanţă autorităţilor la elaborarea răspunsurilor, explicaţiilor, formulărilor de poziţii sau a altor acte, în scopul transmiterii acestora Comisiei Europene, referitoare, în principal, la următoarele cazuri:

Competition Council – national contact authority on State aid between Romania and the European Commission

The Competition Council, as national contact authority in the relation with the European Commission, ensures the application and observance by the public authorities and by the business environment of the State aid rules, as well as an efficient communication with the Community body.

Consultancy on State aid

The experts of the Competition Council have attended 70 working reunions and technical consultations (including video-conferences) and issued 179 written opinions (clarifications) on the observance of the rules on State aid. They have focused on: preparing certain notification to the European Commission on financial support measures, clarifying certain cases under discussion with the Community officials, elaborating certain normative acts incident in the field of State aid, implementing the State aid schemes etc.Thus, during the 1st Semester of 2012, the Competition Council has granted specialized consultancy for the central and local public authorities in the process of elaborating 28 draft normative/administrative acts.

Responses and positions on State aid following to be transmitted to the European Commission

The Competition Council has granted consultancy for the authorities in the process of drafting responses, explanations, positions or other acts to be transmitted to the European Commission, mainly concerning the following cases:


o Contractele preferenţiale de vânzare a energiei electrice încheiate de Hidroelectrica cu ArcelorMittal, ALRO Slatina, opt comercianţi de energie electrică (Energy Holding, Luxten, Europec, Alpiq Romindustries, Alpiq Romenergie, Electrica, Electromagnetica, EFT România), doi producători termo (Electrocentrale Deva şi Termoelectrica) şi doi producători industriali (Elsid Titu şi Electrocarbon Slatina).

o Investigaţia privind facilităţile acordate ilegal de Aeroportul Timişoara în beneficiul Wizz Air;

o Plângerea cu privire la un presupus ajutor de stat acordat de statul român prin intermediul societăţii sale de producere a energiei nucleare, SN Nuclearelectrica SA, furnizorului său de apă grea – Regia Autonomă pentru Activităţi Nucleare (RAAN), sub forma unor preţuri preferenţiale şi prin achiziţionarea unor cantităţi mai mari decât cele necesare.

o Plângerile privind facilităţile acordate ilegal sub forma reducerii de taxe aeroportuare de către Aeroportul Cluj, respectiv Aeroportul Târgu Mureş în beneficiul Wizz Air.

o Plângerea depusă la Comisia Europeană de Greanpeace cu privire la un posibil ajutor de stat ilegal acordat unei societăţi nucleare române (Energo Nuclear).

o Măsurile pe care autorităţile române intenţionează să le adopte în vederea stingerii datoriilor istorice ale S.C. TERMOELECTRICA S.A.

Consultări/discuţii cu Comisia Europeană în vederea dezbaterii propunerilor legislative comunitare în domeniul ajutorului de stat

Experţii Consiliului Concurenţei au participat la 5 întâlniri multilaterale organizate la nivelul Comisiei Europene în vederea discutării modificărilor pe care forul european intenţionează să le opereze asupra reglementarilor comunitare în domeniul ajutorului de stat, având următoarele teme:

modernizarea ajutorului de stat;ajutorul de stat pentru cinematografie şi alte opere audiovizuale;ajutorul de stat în domeniul serviciilor de interes economic general;


o The preferential contracts for selling electricity concluded by Hidroelectrica with ArcelorMittal, ALRO Slatina, eight electricity traders (Energy Holding, Luxten, Europec, Alpiq Romindustries, Alpiq Romenergie, Electrica, Electromagnetica, EFT România), two heating energy producers (Electrocentrale Deva and Termoelectrica) and two industrial producers (Elsid Titu and Electrocarbon Slatina).

o The investigation on the illegal facilities granted by the Timişoara Airport in the benefit of Wizz Air;

o The complaint on an alleged State aid granted by the Romanian state through its producer of nuclear energy, SN Nuclearelectrica SA, its heavy water supplier– the Autonomous Regie for Nuclear Activities (RAAN), under the form of preferential prices and by acquiring larger quantities than needed.

o The complaints on the illegal facilities under the form of airport charges discounts granted by the Cluj Airport and by Târgu Mureş Airport in the benefit of Wizz Air.

o The complaint submitted to the European Commission by Greanpeace on a possible illegal State aid granted to a Romanian nuclear company (Energo Nuclear).

o The measures intended to be taken by the Romanian authorities in order to settle the historical debts of S.C. TERMOELECTRICA S.A.

Consultations/discussions with the European Commission for debating on the Community legislative proposals on State aid

The Experts of the Competition Council have attended 5 multilateral meetings organized at the level of the European Commission for debating the amendments intended to be taken by the European body in respect to the Community regulations on State aid concerning:the modernization of the State aid;the State aid for cinematography and for other audiovisual works;the State aid in the field of the services of general economic interest;


revizuirea Instrucţiunilor privind modificarea regulilor de ajutor de stat regional;

tranzacţionarea certificatelor de emisii de gaze cu efect de seră în perioada de după 2012.

În perioada de referinţă Consiliul Concurenţei a comunicat Comisiei Europene poziţia României privind anumite iniţiative ale forului comunitar sau ale Statelor Membre în materia ajutorului de stat, răspunzând totodată solicitărilor punctuale ale Comisiei Europene în acest domeniu.

Avize (notificări şi exceptări), mecanismul de notificare / informare către Comisia Europeană

În semestrul I al anului 2012 au fost avizate de către Consiliul Concurenţei şi notificate la Comisia Europeană următoarele măsuri de ajutor de stat:

schema de ajutor de stat acordat pentru înfiinţarea de noi destinaţii aeriene cu plecare de pe Aeroportul Internaţional Cluj-Napoca şi

schema de ajutor de stat acordat pentru înfiinţarea de noi destinaţii aeriene cu plecare de pe Aeroportul Internaţional Craiova.

Obiectivul principal al celor două scheme de ajutor îl reprezintă facilitarea deschiderii de noi rute şi/sau frecvenţe de operare aeriene cu plecare de pe Aeroportul Internaţional Cluj-Napoca, respectiv Aeroportul Internaţional Craiova, având ca destinaţie oraşe din Uniunea Europeană, ceea ce va îmbunătăţi accesul la serviciile de transport aerian, servicii de o importanţă fundamentală pentru dezvoltarea judeţelor Cluj şi Dolj.

Au fost avizate de Consiliul Concurenţei şi transmise spre informare Comisiei Europene următoarele măsuri de ajutor de stat care intră în domeniul de aplicare al exceptărilor pe categorii de la obligaţia de notificare:

schema de ajutor de stat pentru sprijinirea şi implementarea operaţiunii “Dezvoltarea structurilor de sprijin al afacerilor de interes naţional şi internaţional – Poli de competitivitate”;


the review of the Instructions on the amendment of the regional State aid;

the transaction of the greenhouse gas emission certificates after 2012.

In the period of reference, the Competition Council has communicated to the European Commission the position of Romania on certain initiatives in the field of State aid of the Community body or of other Member States, responding at the same time to the punctual requests of the European Commission in this field.

Formal opinions (notifications and exemptions), the notification / informing mechanism to the European Commission

During the 1st Semester of 2012, the Competition Council issued formal opinions on and notified to the European Commission the following State aid measures:

the State aid scheme for the start-up of new air routes with departure from the International Cluj-Napoca Airport and

the State aid scheme concerning the start-up of new routes departing from Craiova International Airport.

The main objective of the two State aid schemes is to facilitate the start-up of new routes and/or of aerial operating frequencies departing from the International Cluj-Napoca Airport and from Craiova International Airport and having as destination cities from the European Union, which will improve the access to the flying transport services, which have a fundamental importance for developing the counties of Cluj and Dolj.

The following measures subject to the general block exemptions have received the formal opinion of the Competition Council and have been announced to the European Commission:

the information sheet regarding the State aid scheme „Development of the support structures for the business of


ajutorul de stat pentru proiecte mari de investiţii acordat SC ROMCAB SA în cadrul schemei de ajutor de stat privind asigurarea unei dezvoltări economice durabile, implementată prin HG nr. 1680/2008;

ajutorul de stat pentru proiecte mari de investiţii acordat SC ROBERT BOSCH SRL în cadrul schemei de ajutor de stat privind asigurarea unei dezvoltări economice durabile, implementată prin HG nr. 1680/2008;

modificarea şi completarea HG nr. 750/2008 pentru aprobarea Schemei de ajutor de stat regional pentru valorificarea resurselor regenerabile de energie.

Forului comunitar i-au mai fost înaintate informări cu privire la prelungirea duratei de aplicare a următoarelor 2 scheme de pentru formare profesională generală si specifică denumite „Bani pentru completarea echipei” şi „Bani pentru formare profesională”.

Consiliul interministerial privind politica în domeniul ajutorului de stat (CIAS)

În prima parte a anului 2012, a avut loc o reuniune CIAS1 la care au participat reprezentanţii celor mai importanţi furnizori de ajutor de stat din România. În cadrul reuniunii au fost abordate următoarele aspecte:

prezentarea principalelor cazuri rezolvate sau în curs de rezolvare de la ultima întâlnire a CIAS (Compania Naţională a Huilei, S.C. Oltchim Râmnicu Vâlcea S.A., S.C. Ford România S.A.);

aprobarea poziţiei României faţă de modificările aduse Liniilor directoare privind ajutorul de stat regional;

informare privind implementarea la nivelul Consiliului Concurenţei a unui nou sistem informatic de raportare a ajutoarelor de stat (SARI – State Aid Reporting Interactive) către Comisia Europeană, începând cu anul curent.

national and international interest – Competitiveness Poles”; the information sheet regarding the State aid for large investment

projects granted to SC ROMCAB SA within the State aid scheme for ensuring a lasting economic development, implemented by the GD no. 1680/2008;

the information sheet regarding the State aid for large investment projects granted to SC ROBERT BOSCH SRL within the State aid scheme for ensuring a lasting economic development, implemented by the GD no. 1680/2008;

the amendment of the regional State aid scheme on the capitalization of the renewable energy resources, set up by the Government Decision no.750/2008.

The Community body has been also informed on the prolongation of the following 2 general and specific training schemes named “Money for staffing” and “Money for training”.

The Inter-Ministry Council on the State aid Policy (CIAS)

During the first part of 2012, a CIAS1 reunion has been organised, attended by representatives of the most important Romanian State aid suppliers. This reunion has focused on the following issues:

presentation of the main cases solved or still under analysis since the last CIAS reunion (The National Coal Company, S.C. Oltchim Râmnicu Vâlcea S.A., S.C. Ford România S.A.);

the approval of Romania’s position on the amendments brought to the Guidelines on the regional State aid;

information on the implementation at the level of the Competition Council of a new State aid reporting system (SARI – State Aid Reporting Interactive) to the European Commission starting with this year.

Programul de Twinning ,,Sprijinirea implementării politicii în domeniul concurenţei şi ajutorului de stat în Republica Moldova”

În cadrul acţiunilor din Programul de Twinning desfăşurate în Republica Moldova:

s-au organizat întâlniri cu furnizorii de ajutor de stat în vederea instruirii şi familiarizării acestora cu privire la noţiunea/conceptul de ajutor de stat, precum şi la aspectele legate de modalitatea de raportare către Agenţia Naţională pentru Protecţia Concurenţei a ajutoarelor de stat pe care le acordă;

în vederea identificării unor posibile măsuri de ajutor de stat şi a furnizorilor care le-au acordat, au fost analizate peste 250 de acte normative şi administrative elaborate de autorităţile publice din Republica Moldova;

a fost elaborată legislaţia secundară în aplicarea legii care reglementează domeniul ajutoarelor de stat din Republica Moldova.

Programul ReNAS

Consiliul Concurenţei a continuat activitatea în cadrul Programului „Reţeaua Naţională de Ajutor de Stat” - ReNAS. În vederea asigurării îndeplinirii, în bune condiţii, a activităţii de raportare a ajutoarelor de stat acordate în cursul anului 2011, Consiliul Concurenţei a organizat o întâlnire interministerială cu principalii furnizori de ajutor de stat la nivel naţional, în cadrul căreia au fost discutate aspecte referitoare la modalitatea de raportare a ajutoarelor de stat, termenele de raportare şi modalitatea concretă de transmitere a informaţiilor de către furnizori.


The Twinning Programme “Support to implementing the policy on competition and State aid in the Republic of Moldova”

Within the Twining Project carried out in the Republic of Moldova: meetings have been organised with the State aid suppliers for

training and getting them familiarised with the notion/concept of State aid, as well as with the other aspects related to the manner of reporting to the National Agency for the Protection of Competition the State aids granted by them;

so as to identify certain possible State aid measures and the State aids supplied, 250 normative and administrative acts have been analysed, which have been elaborated by public authorities of the Republic of Moldova;

the secondary legislation on State aid in the Republic of Moldova has been elaborated.

The ReNAS Programme

The Competition Council has continued the activity within the Programme “State aid National Network” - ReNAS. For ensuring the proper fulfilment of the reporting of the State aids granted during 2011, the Competition Council has organised an Inter-Ministry meeting with the main State aid suppliers at the national level, focused on issues related to the manner of State aid reporting and on the actual transmission, on the reporting deadlines, as well as on the actual manner of transmitting the information to the suppliers.


Activitatea de raportare, monitorizare şi control al ajutorului de stat

•A fost transmis Comisiei Europene Situaţia privind ajutoarele de stat existente, raportare necesară pentru întocmirea Scoreboard-ului ajutoarelor de stat acordate în Uniunea Europeană.

•În conformitate cu prevederile Regulamentului privind procedurile de monitorizare a ajutoarelor de stat au fost înregistrate raportări de la un număr de peste 220 de furnizori de ajutor de stat. S-a înregistrat un număr de peste 10.000 de beneficiari de ajutoare de stat iniţiate şi implementate în baza a peste 130 de acte normative şi administrative. Analiza efectuată de Consiliul Concurenţei a avut în vedere veridicitatea datelor transmise, respectiv cuantumul ajutoarelor de stat acordate în perioada 2009-2011, natura şi modalitatea de acordare, precum şi baza legală de acordare a acestora.

•A fost întocmită Situaţia ajutoarelor de stat cu obiectiv cercetare-dezvoltare-inovare, situaţie solicitată separat de către Comisie, conform prevederilor Cadrului comunitar pentru ajutoarele de stat pentru cercetare, dezvoltare şi inovare.

•A fost transmis Comisiei Europene Raportul privind ajutoarele de stat acordate pentru compensarea serviciilor de interes economic general din România în perioada 2009-2011, întocmit conform prevederilor Deciziei CE nr.842/2005 privind aplicarea articolului 86 alin. (2) din Tratatul CE.

•A fost finalizat Raportul anual al ajutoarelor de stat acordate în România în perioada 2008-2010, transmis Guvernului spre informare şi publicat în Monitorul Oficial nr.363 bis din 29 mai 2012.


State aid reporting, monitoring and control

•The Situation on the existing State aids has been transmitted to the European Commission, a necessary report for drafting the Scoreboard of the State aids granted within the European Union.

•In accordance with the provisions of the Regulation on the State aid, 220 State aid suppliers and over 10,000 beneficiaries have been recorded in respect to State aids granted through over 130 normative and administrative acts. The analysis of the Competition Council has been based on the accuracy of the supplied data, namely the quantum of the State aids granted during 2009-2011, their nature and manner of granting, as well as their legal base.

•The Situation of the State aids for research, development & innovation has been elaborated, which has been requested separately by the European Commission, according to the Community framework for the research, development & innovation State aids.

•The Report on the State aids granted for compensating the services of general economic interest in Romania during 2009-2011 has been transmitted to the European Commission, being drafted according to the EC Decision no.842/2005 on the application of art.86(2) of the EC Treaty.

•The Annual Report on the State aids granted in Romania during 2008-2010 has been finalised, transmitted for information to the Government and published in the Official Gazette no.363 bis of 29 May 2012.


Consiliul de supraveghere în domeniul feroviarÎn prima parte a anului 2012, Consiliul de supraveghere în domeniul feroviar (Consiliul Feroviar) a continuat seria întâlnirilor lunare ṣi analizelor cu reprezentanţi ai operatorilor publici şi privaţi din sectorul feroviar, pentru cunoaṣterea problemelor cu care se confruntă societăţile din domeniul feroviar şi găsirea unor soluţii adecvate pentru remedierea acestora.

În vederea clarificării problemelor semnalate de întreprinderile feroviare, Consiliul Feroviar a organizat dezbateri cu reprezentanţi ai gestionarului infrastructurii feroviare, ai Autorităţii Feroviare Române ṣi ai Centrului Naţional de Calificare şi Instruire Feroviară. În cadrul acestor dezbateri a fost pus în discuţie modul în care se calculează tariful de utilizare a infrastructurii, modul în care se asigură echilibrul în relaţia dintre C.F.R. S.A. ṣi operatorii feroviari, precum ṣi situaţia actuală a furnizării şi asigurării energiei electrice de tracţiune din sectorul feroviar.

Alte activităţi: participarea la conferinţe naţionale şi la reuniuni organizate la nivel

european în domeniul feroviar; întâlniri cu reprezentanţii Fondului Monetar Internaţional, Băncii

Mondiale şi Comisiei Europene având ca obiect organizarea şi funcţionarea Consiliului Feroviar;

discuţii cu reprezentanţii Ministerul Transporturilor şi Infrastructurii şi Ministerul Afacerilor Europene în vederea adoptării la nivel naţional a măsurilor necesare în vederea soluţionării cauzei 2008/2108, astfel încât procedura de infringement declanşată de Comisia Europeană în anul 2008 cu privire la Consiliul Feroviar din România să nu fie continuată cu o eventuala sesizare a Curţii de Justiţie a Uniunii Europene.


The Railway Supervision Council

During the first part of 2012, the Railway Supervision Council has continued the monthly meetings and analyses with the representatives of the public and private operators from the railway sector, so as to get familiarised with the issues they are confronting and for identifying the adequate solutions for solving them.

In order to clarify the problems signalled by the railway undertakings, the Railway Supervision Council has organised debates with the representatives of the railway infrastructure manager, of the Romanian Railway Authority and of the National Centre for Qualification and Training in the Railway field. These debates have focused on the calculation of the tariff for using the infrastructure, the manner of achieving the equilibrium within the relation between C.F.R. S.A. and the railway operators, as well as on the actual situation of supplying the traction electricity in the railway field.

Other activities: attending the national conferences and the reunions on the railway

filed organised at the European level; meetings with the representatives of the International Monetary

Fund, of the World Bank and of the European Commission focused on the organising and the functioning of the Railway Supervision Council;

discussions with the representatives of the Ministry of Transports and Infrastructure and of the Ministry of European Affairs so as to adopt at the national level the necessary measures for solving the Case 2008/2108, with the aim of stopping the infringement procedure concerning the Romanian Railway Supervision Council, opened by the European Commission in 2008, from being further followed with a possible intimation of the European Union Court of Justice.
