Artekalor nasce a Verbania nel 2006, specializzandosi nella produzione di radiatori e facendo della qualità un obiettivo primario della propria attività.Grazie all’esperienza dei fondatori nel campo dello stampaggio, a tecnologie produttive d’avanguardia e a collaborazioni con designer di fama internazionale (tra cui Karim Rashid, Ron Arad e Roberto Semprini) l’azienda si è subito imposta sul mercato nazionale ed internazionale, arrivando anche ad esporre alla permanente del MAD di New York alcuni articoli della produzione design.

Nel corso del 2008 viene ideata una nuova linea di radiatori che affi anca le due già in produzione da cui nascono il modello Flox, fi ore termoilluminato che rappresenta una innovazione nel campo dei radiatori da riscaldamento, il modello Kiton ad alta resa termica, modulare e completamente in alluminio riciclato e il block Twenty che sarà oggetto di brevetto industriale depositato nel 2009.

Il 2012 porta una novità importante all’interno dell’azienda: nasce una collezione di Biocamini.Elementi riscaldanti di grande impatto visivo ed emotivo, che impreziosiscono l’ambiente domestico senza produrre fumi inquinanti. Non sostituiscono l’impianto di riscaldamento classico, ma ne sono un ottimo complemento.

L’azienda con ottimismo al futuro, portando con sé voglia di cambiamento, studiando e realizzando oggetti di design che si inseriscono alla perfezione in ogni tipo di ambiente. Raffi nati ed esclusivi, rappresentano l’evoluzione tecnica e funzionale del radiatore concepito non solo come semplice corpo scaldante, ma come oggetto d’arredo e di design.

Artekalor was established in Verbania in 2006, specializing in the production of radiators and making quality a primary objective of its business activity.

With the experience of the founders in the fi eld of molding, cutting-edge production technologies and collaborations with Internationally renowned designers (including Karim Rashid, Ron Arad and Roberto Semprini) the company has been imposed on the domestic and international market arriving to exhibit some of their range in the production design at MAD’s New York (permanent).

In 2008 a new line of radiators were designed to add to the two already in production which created the model Phlox fl ower termoilluminato which is an innovation in the fi eld of radiators for heating.

The Kiton model has a high thermal effi ciency, modular and completely Twenty recycled aluminum and the block will be the subject of industrial patents fi led in 2009.

The year 2012 brings an important new development within the company, a collection of Biocamini launched. Heating elements of great visual and emotional impact that enhance the home environment without producing polluting fumes. They do not replace the traditional heating system, but they are a great complement.

The company is optimistic about the future, bringing with it a desire for change, studying and creating design objects that fi t perfectly into any environment. Elegant and exclusive, these products represent the evolution of technical and functional radiator conceived not only as a simple heating unit, but as a piece of furniture and design.

Design and technology come together in this radiator designed by the renowned designer Ron Arad. Arabesque was created by the movement of a double ellipse tubular steel that winds poetically to create a series of “8” winding shapes. It can be used both vertically and horizontally, becoming also a handy towel rail.Only available with hydraulic operation.

Drag nasce come elegante alternativa ai classici radiatori multicolonna; è un radiatore componibile a sezione singola 60x30 cm, realizzato in altezze da 400 a 1800 mm.Inizialmente prodotto solo in acciaio inox polished, viene ora fornito a richiesta anche in fe al carbonio con trattamento di cromatura o verniciatura a colori RAL.

Drag emerged as an elegant alternative to the traditional multicolumn radiators. This radiator is a single modular section 60x30 cm, made in heights from 400 to 1800 mm. Flox è un radiatore modulare, completamente personalizzabile, che offre la possibilità di molteplici confi gurazioni. Il concetto creato da Karim Rashid stravolge completamente l’idea di radiatore e si sviluppa in una direzione più scultorea che di design.Gocce in alluminio che irradiano calore e che ruotando possono fungere da sostegno per salviette o semplicemente arredare un angolo della casa a supporto del riscaldamento principale.

Realizzato in due versioni: Line e Free-standing.La versione Line, orizzontale, è prevista con la duplice opzione elettrica / idraulica.Il funzionamento elettrico (con resistenza a 300-400W) permette di posizionare il radiatore in ogni luogo della casa.La versione Free-standing viene proposta unicamente con funzionamento elettrico (con resistenza autoregolante a 300 watt).

Concept minimale ma con un grande potenziale decorativo, Twenty, elemento scaldante di dimensioni contenute e aspetto essenziale, si presta ad interpretare i vostri spazi. Ogni modulo di 20x20 cm (spessore 5 cm), realizzato in alluminio pressofuso e disponibile in diverse fi niture, lucido, satinato e colorato, si presta a molteplici combinazioni partendo da un numero minimo consigliato di tre elementi. La possibilità di disporre i moduli sia in orizzontale, come mensola da riscaldamento, che in verticale, per ottenere composizioni geometriche, spiana la strada alla creazione di moltissime combinazioni, alcune standard altre assolutamente personalizzabili a seconda dell’ampiezza degli spazi e del calore del quale si ha necessità. Moon, cover dalle forme retrò ispirata alla corrente artistica Optical, sviluppatasi intorno agli anni ’70.L’unione delle 2 cover, la prima con mezzi cerchi in rilievo, la seconda con mezzi cerchi in avvallamento, vanno a creare dei cerchi perfetti realizzando una scultura statica che abbina forme e colori di forte illusione ottica tanto che il radiatore osservato attentamente per qualche minuto sembra prendere vita.Cover realizzata in alluminio e consigliata nei colori RAL tono su tono per poter ricreare gradazioni uniche.

Nonostante tutte le tendenze di riscaldamento degli ultimi 10 anni, i radiatori a pannello in acciaio rimangono tra i più economici, affi dabili, pratici e a risparmio energetico.

Offriamo una produzione completa con 5 differenti modelli (10, 11,21,22,33) in 5 differenti altezze (300-400-500-600-900mm) e in 12 differenti lunghezze tra i 400 e i 2600 mm. Questa straordinaria gamma soddisfa qualsiasi necessità del cliente sia privato che commerciale, per la casa o qualsiasi altro luogo, come l’uso industriale.

Tutti i nostri radiatori a pannello in acciaio sono caratterizzati da un design contemporaneo e funzionale.

Disponibili anche nel modello 10-20 in versione verticale da 1600mm a 2000mm.

I radiatori a pannello vengono forniti con mensole, tappi, guarnizioni, tasselli e viti per l’installazione.

Il radiatore a pannello sfrutta il sistema a fl usso parallelo che riscalda in modo uniforme tutte le piastre del radiatore. Per il 95% circa del periodo di accensione, una temperatura superfi ciale molto inferiore ai 40° C è suffi ciente per ottenere la temperatura ambiente desiderata. All our steel panel radiators feature a contemporary and functional design.Also available in model 10-20 in vertical version of 1600mm to 2000mm.The panel radiators are supplied with brackets, plugs, gaskets, bolts and screws for installation.The radiator panel takes advantage of the parallel fl ow system that heats all the plates of the radiator evenly.For approximately 95% of the period of ignition, a surface temperature much lower than 40° C is suffi cient to achieve the desired room temperature.With the parallel fl ow and surface heat higher, the advantage is clear: comfort 100% of the time with a consequent saving of energy up to 10% compared to traditional radiators, up to 20% lesstime for the heating of the radiator.

Electric / dual towel

Numerosi radiatori Artekalor possono essere utilizzati a funzionamento elettrico o misto. Il radiatore è fornito con la dotazione composta da una resistenza elettrica dalla potenza appropriata, modello AK-G e, a richiesta, da un’unità di regolazione.

Radiatori elettrici

I radiatori elettrici sono dotati di resistenza elettrica preinstallata, modello AK-G, riempiti con liquido anti-corrosione e antigelo (max garantito fi no a -10° C), testato e sigillato. Il radiatore può essere utilizzato immediatamente dopo essere stato acquistato ed installato come da manuale di istruzioni. Il regolatore, fornito a richiesta in abbinamento alla resistenza, è di colore bianco standard e, a richiesta, per i radiatori Cromo e Inox color argento. Disponibili regolatori nei modelli cromo satinato - antracite - acciaio - oro - nero.

Radiatori misti

I radiatori misti vengono utilizzati in abbinamento alla linea di riscaldamento idraulico concedendo la possibilità di riscaldare il locale anche quando l’impianto è spento. Il radiatore misto viene fornito con la resistenza base (mod. AK-G). Il kit comprende anche una connessione a T (inserire codice di riferimento preso da scheda accessori) per il collegamento al sistema di riscaldamento.Il radiatore dovrà essere installato montando la valvola termostatica sul lato opposto al termostato della resistenza che dovrà essere chiusa quando si azionerà elettricamente il radiatore onde evitare ritorni di acqua calda nell’impianto di riscaldamento. Il regolatore di temperatura opzionale e il “T” forniti in abbinamento alla resistenza sono di colore bianco standard e, a richiesta, per i radiatori Cromo e Inox color argento. Disponibili regolatori e “T” nei modelli cromo satinato - antracite - acciaio - oro - nero. Arterkalor mette a disposizione dei clienti delle particolari valvole “COMBY” (inserire codice di riferimento) per l’utilizzo delle resistenze senza l’impiego del raccordo a “T” con fi niture in abbinamento al radiatore per meglio valorizzare il vostro termo arredo di design.

Electric towel radiators

Dual radiators are used in combination with the hydraulic heating line giving the possibility to warm up the room even when the system is off. The dual radiator comes with the resistance base (mod. AK-G).The kit also includes a T-connection for connection to the heating system (insert reference code from “Accessories sheet”). The cooler must be installed by mounting the thermostatic valve on the side opposite to the thermostat of the resistance that must be closed when you operate electrically the radiator in order to avoid carriage returns in hot water heating system. The regulator and T provided in combination with the resistance, are white standards and, on request, to Chrome radiators and Inox color silver. Available controllers and “T” models in satin chrome - anthracite - steel - gold - black.Arterkalor makes available to customers of special valves “Comby” (insert reference code) for the use of resistance without “T”. Valves “Comby” have fi nishes in style to deliver more value your design towel rail.

Posizionamento dei radiatori elettrici / misti

I radiatori elettrici e i radiatori misti devono essere posizionati nelle zone 2 e 3 (secondo le norme EN442). La presa di corrente deve essere posizionata fuori dalle zone 0, 1 e 2.I radiatori devono essere collegati (salvo diverse indicazioni) solo alla tensione nominale di 230 V 50/60 Hz corrispondente alla presa in conformità della norma EN442.

Posizionamento della resistenza / Proportioning the heating rod

Accertarsi che l’impianto elettrico dello stabile sia conforme alle norme CEI 64.8 e protetto da un interruttore differenziale accertandosi che l’impianto di messa a terra sia effi ciente e conforme alle disposizioni CEI.

Location of the electric / dual radiators in the bathroom

Electric radiators and dual radiators should be placed in zones 2 and 3 (in accordance with the rules EN442). The socket must be positioned outside the zone 0, zone 1 and 2 the radiators must be connected (unless otherwise prescribed) only to the nominal voltage of 230 V 50/60 Hz corresponding to taken in accordance with the standard EN442.

Make sure that the electrical equipment of the building complies with CEI 64.8 and protected by a breaker ensuring that the grounding system is effi cient and complies with CEI.

• Il termostato deve essere installato in posizione verticale con la linea di alimentazione collegata dal basso • I watt di potenza della resistenza sono calcolate in funzione delle dimensioni e dell’uso del singolo radiatore. L’uso di barre di riscaldamento con potenza superiore non aumenta la resa termica in uscita, al contrario, riduce la durata della resistenza stessa • I tappi installati sul radiatore non devono essere allentati • I radiatori destinati ai bagni devono essere installati in modo che le persone nella vasca da bagno o nella doccia non possono toccare l’apparecchio di controllo della resistenza. L’installazione non corretta potrebbe danneggiare l’apparecchio o causare scosse elettriche o bruciature • Il radiatore non deve essere posto direttamente sotto di una presa di corrente. L’idoneità della presa di corrente dove essere testata da un elettricista professionista • Il radiatore deve essere installato almeno a 25cm dal pavimento• La normativa nazionale deve essere osservata durante il montaggio del radiatore • I termostati sono collegati alla rete elettrica 230V 50Hz utilizzando un terminale mobile con una spina e presa normalizzata installati ai sensi della normativa UNI. L’apparecchio deve essere protetto da un differenziale• La protezione contro le scosse elettriche deve essere regolata dalla normativa nazionale • Nel caso l’apparecchio sia permanentemente attaccato alla rete elettrica un interruttore di sicurezza deve essere montato sul terminale del termostato ed essere accessibile per la manutenzione• Il collegamento alla rete elettrica e la verifi ca di corretta installazione deve essere eseguita da un elettricista professionista

Rules for installation and using electric / dual radiators

Incorrect installation may damage the equipment or cause electrical shock or burns • Radiator should not be place directly below an outlet. The suitability of the socket to be tested by a professional electrician • The cooler must be installed at least 25 cm from the fl oor• The national legislation must be observed when mounting radiator • Thermostats are connected to the power supply 230V 50 Hz using a mobile terminal with a plug and socket normalized installed pursuant to UNI. The apparatus shall be protected by a differential. • Protection against electric shock must be regulated by national legislation • In case the unit is permanently attached to a power grid safety switch must be mounted on the terminal of the thermostat and be accessible for maintenance• Connection to the electricity network and verifying proper installation must be performed by a professional electrician

GMÈ il regolatore di calore standard.Il quadrante del termostato viene utilizzato per la regolazione della temperatura tra i 7 e i 35° C. Nella posizione più bassa il termostato è disattivato, nella posizione più alta è costantemente acceso. L’installazione è consigliata sul radiatore nella parte bassa a destra.

GFQuesto regolatore è dotato di 2 pulsanti e una manopola. Per attivare ON/OFF si preme il pulsante in basso: quando il regolatore è ON e il LED è rosso, l’apparecchio è alimentato (fase riscaldamento), quando il LED è verde il regolatore è spento. La temperatura desiderata viene selezionata tra i 15 e i 30° C con la manopola di regolazione. Per attivare la funzione antigelo, ruotare la manopola sulla posizione minima e la temperatura sarà di 7°C costante. Nella posizione massima il riscaldamento è costante. Premendo il pulsante in alto il sistema passa in modalità di riscaldamento per 2 ore, quando il led lampeggia si ritorna alle impostazioni originali.

GFThis regulator is equipped with 2 buttons and a rotary knob. To turn ON/OFF button is pressed down: when the driver is ON and the LED is red, the appliance is powered (step heating), when the LED is green, the controller is turned off. The desired temperature is between 15 and 30° C with the knob. To activate the antifreeze, rotate the knob on the lowest position and the temperature of 7° C will be constant. Maximum heating position is constant. By pressing the top button the system passes in heating mode for 2 hours, when the led blinks back to the original setting.

Condizioni generali di vendita

Art. 1 – Premesse1.1 Le presenti Condizioni Generali, aventi ad oggetto i prodotti e gli accessori concepiti e fabbricati da Artekalor S.r.l. (di seguito “il Venditore”) nonché i prodotti fabbricati da terzi e da quest’ultimo venduti, regoleranno tutti gli attuali e futuri contratti di vendita tra le parti. Eventuali modifi che o deroghe dovranno essere concordate per iscritto.

Art. 2 – Ordini di acquisto2.1 Gli ordini di acquisto raccolti dal Venditore ovvero dai suoi agenti e rappresentanti non sono per lui vincolanti fi no a quando non siano stati confermati per iscritto (per fax o via e-mail) con accettazione dell’ordine (conferma d’ordine) da parte del Venditore. In caso di offerta del Venditore, essa è valida per 30 giorni dalla data del suo arrivo presso il destinatario. Dopo tale data l’offerta è considerata ineffi cace.

Art. 3 – Prezzi3.1 I prezzi sono quelli indicati nei listini prezzi in vigore al momento dell’accettazione dell’ordine di acquisto da parte del Compratore. I listini prezzi sono espressi in euro. Da tutti i prezzi e dagli addebiti è esclusa l’imposta sul valore aggiunto (I.V.A.) e ogni altra tassa, dazio e spesa. Inoltre essi non comprendono le spese di trasporto, le spese postali, assicurative ed altri costi relativi alla resa dei prodotti. 3.2 Qualsiasi caratteristica, opzione, modifi cazione particolare dei Prodotti richiesta dal Compratore sarà addebitata separatamente e sommata al prezzo dell’offerta.

Art. 4 – PagamentiLe condizioni di pagamento sono quelle indicate nelle conferme d’ordine di acquisito. In mancanza di tale indicazione, il prezzo di acquisto dovrà essere pagato in anticipo o alla consegna e nella valuta riportata sulla fattura. 4.1 I pagamenti debbono essere effettuati nei modi ed alla scadenza concordati dalle parti in ogni singolo ordine di acquisto. 4.2 Eventuali pagamenti fatti ad agenti, rappresentanti o ausiliari di commercio del venditore non si intendono effettuati fi nché le relative somme non pervengano al Venditore. 4.3 Se il compratore ritarda nell’effettuare qualsiasi pagamento, il Venditore ha diritto al pagamento degli interessi a partire dalla data alla quale la somma diviene esigibile. Il Venditore avrà inoltre facoltà, dietro comunicazione scritta inviata al Compratore, di sospendere l’adempimento delle proprie obbligazioni sino a che detto pagamento sia effettuato. 4.4 Nel caso in cui il Compratore non paghi la somma dovuta entro 30 giorni, il Venditore ha diritto, previa comunicazione scritta al Compratore, di recedere dal contratto e di ottenere dal Compratore il risarcimento dell’ammontare del danno subito. 4.5 Nel caso di pagamenti dilazionati, il mancato pagamento anche di una sola rata fa decadere il diritto alla dilazione ed autorizza il Venditore a richiedere il saldo immediato.

Art. 5 – Riserva di proprietà5.1 I Prodotti restano di proprietà del Venditore sino al momento del completo pagamento del prezzo di acquisto. 5.2 Il Compratore deve fornire ogni assistenza al Venditore stesso nel prendere qualsiasi misura necessaria per proteggere il diritto di proprietà sui Prodotti di quest’ultimo. 5.3 La riserva di proprietà non pregiudica il trasferimento del rischio così come previsto ai sensi dell’art. 6.

Art. 6 – Consegna6.1 Il Venditore consegna i Prodotti al Compratore entro la data indicata sulla conferma d’ordine. Se non specifi cato nella consegna d’ordine, il Venditore fornirà i Prodotti entro 60 giorni dalla data dell’accettazione dell’ordine. Consegne parziali sono ammesse se non stabilito differentemente.

6.2 Il Venditore non incorrerà in alcuna responsabilità nel caso di spedizione della merce successivamente al termine convenuto con il Compratore; pertanto in caso di ritardo nella consegna della merce nessun diritto al risarcimento di danni diretti o indiretti e/o alla risoluzione del contratto sarà riconosciuto dal Venditore al Compratore, che fi n da ora vi rinuncia / tuttavia il Compratore ha il diritto di richiedere il risarcimento dei danni patiti per un ammontare massimo del 1% (uno per cento) del prezzo di acquisto. 6.3 La consegna dei Prodotti si intende eseguita ad ogni effetto con la comunicazione da parte della Venditrice che questo è a disposizione del Compratore, oppure che è stato consegnato al vettore per il trasporto. Salvo diversa pattuizione scritta, la consegna sarà effettuata Franco Fabbrica (CCI -Incoterms 2010) nel luogo indicato nella conferma d’ordine dal Venditore e ciò ove anche sia pattuito che la spedizione venga curata dal Venditore, nel qual caso quest’ultimo agirà quale mandatario del Compratore essendo inteso che il trasporto verrà effettuato a spese e rischio di quest’ultimo. 6.4 Se il Compratore non esegue il ritiro alla data di consegna indicata nel contratto di vendita, deve ugualmente pagare per intero il prezzo di acquisto che diventa esigibile dalla data di consegna come se essa fosse stata eseguita. Il Venditore deve provvedere al magazzinaggio dei Prodotti a rischio e a spese del Compratore.

Art. 7 – ImballaggioArtekalor utilizza imballaggi standard (scatole, pallet). In caso di esigenze particolari legate al luogo di destinazione, Artekalor utilizzerá imballi specifi ci.

Art. 8 – Reclami e garanzia8.1 Nei limiti delle disposizioni che seguono, il Venditore si impegna a rimediare a qualsiasi imperfezione che sia conseguenza di un difetto di progettazione, di materiali o di lavorazione. Tale garanzia non si applica nel caso in cui il Compratore non provi di aver effettuato un corretto uso, manutenzione e conservazione dei prodotti e di non averli modifi cati o riparati senza il consenso del Venditore. Tale impegno è limitato ai difetti che si manifestano durante il periodo di due anni dalla data della consegna. 8.2 Il Compratore deve notifi care al Venditore tutti i difetti che si siano manifestati entro 8 (otto) giorni dalla loro scoperta. Qualora il difetto sia tale da poter causare dei danni, la notifi ca deve essere effettuata immediatamente. Se il Compratore non notifi ca al Venditore un difetto entro il termine stabilito in questo articolo, egli perde il suo diritto ad avere il difetto rimediato. La notifi ca e i reclami devono contenere la descrizione del difetto e devono essere trasmessi al Venditore a mezzo di lettera raccomandata con ricevuta di ritorno. 8.3 Su ricevimento di tale notifi ca scritta e una volta accertati i fatti denunciati, il Venditore è tenuto a sostituire o riparare i Prodotti difettosi. 8.4 Il Venditore può richiedere la resa, a spese del compratore, dei Prodotti difettosi sostituiti che diventeranno di sua proprietà. In ogni caso, le rese dei Prodotti dovranno essere preventivamente accettate dal Venditore. 8.5 A seguito dell’analisi del prodotto difettoso, se risulta che il difetto non è imputabile al Venditore, la riparazione o la sostituzione saranno a carico del Compratore, comprese tutte le spese di spedizione. 8.6 La garanzia di cui al presente articolo é valida soltanto se il Compratore usa i Prodotti seguendo le indicazioni contenute nel catalogo del Venditore ed assorbe e sostituisce ogni altra garanzia legale per vizi e conformità ed esclude ogni altra responsabilità del Venditore in particolare per danni diretti o consequenziali inclusi costi di trasporto, mancato utilizzo, mancati profi tti, perdita di contratto o per qualsiasi altro danno indiretto.

Art. 9 – Disegni e documenti descrittivi9.1 Le dimensioni, le capacità, i prezzi, i rendimenti, i colori e i dati fi guranti nei documenti illustrativi del Venditore, così come le caratteristiche dei campioni e modelli da quest’ultimo inviati al Compratore, hanno carattere di indicazione approssimativa. Questi dati hanno valore impegnativo solo se sono stati espressamente menzionati come tali nell’accettazione scritta del Venditore.9.2 Qualsiasi disegno o documento tecnico che permetta la fabbricazione o il montaggio dei prodotti venduti o di loro parti e sia rimesso al Compratore, tanto prima che dopo la stipulazione del contratto, rimane di esclusiva proprietà del Venditore. I suddetti disegni o documenti non possono essere utilizzati dal Compratore o copiati, riprodotti o trasmessi a terzi senza il consenso del Venditore. In caso di violazione della presente clausola, il Compratore si obbliga a pagare al Venditore la somma di 100.000,00 Euro più 100,00 Euro per ogni giorno in cui tale violazione sarà fatta perdurare, salvo il risarcimento di ogni maggior danno.

Art. 10 – Norme tecniche e responsabilità per danni originati dai prodotti10.1 Il Venditore dichiara che i Prodotti sono fabbricati in conformità alla legislazione e alle norme tecniche italiane. 10.2 Il Venditore, salvo la sua provata grave negligenza, non è responsabile per qualsiasi danno a persone o cose originato dai Prodotti. Qualora il Venditore incorra nella responsabilità verso terzi per tali danni, il Compratore deve risarcire, difendere e tenere indenne il Venditore.

Art. 11 – Forza maggiore e hardship11.1 Ciascuna Parte sarà autorizzata a sospendere l’adempimento dei propri obblighi derivanti dal contratto per un periodo non superiore a 45 giorni qualora tale adempimento sia ostacolato o reso irragionevolmente oneroso a causa del verifi carsi di una delle seguenti circostanze: controversie commerciali e ogni altra circostanza al di fuori delle possibilità di controllo delle Parti come incendi, guerre (sia dichiarate che non dichiarate), mobilitazioni militari generali, insurrezioni, requisizioni, sequestri, restrizioni nell’uso di energia, perturbazioni nei trasporti, scioperi, serrate, fermi di produzione dovuti a cause tecniche non ragionevolmente prevedibili e difetti o ritardi nelle consegne da parte di fornitori. Trascorso il termine di cui sopra di 45 giorni e permanendo la situazione di forza maggiore, l’altra Parte potrà risolvere il contratto mediante comunicazione scritta alla parte colpita da tale impedimento. Quest’ultima parte non avrà in tal caso alcun obbligo di risarcimento danni. 11.2 Nel caso in cui, a causa di un qualsiasi evento ragionevolmente imprevedibile da un imprenditore del settore dotato di normale esperienza, l’adempimento degli obblighi del Venditore sia divenuto, prima della esecuzione, eccessivamente oneroso rispetto agli obblighi contrattuali precedentemente pattuiti in misura tale da modifi carne il rapporto per più del 20%, il Venditore avrà diritto di richiedere la modifi ca delle condizioni contrattuali o, in mancanza di tale modifi ca, di risolvere il contratto.

Art.12 – Varie12.1 Il Venditore ha il diritto di sospendere l’adempimento delle proprie prestazioni in presenza di un mutamento delle condizioni patrimoniali del Compratore tale da far ritenere che quest’ultimo non adempirà all’obbligazione di pagamento. In tali casi il Compratore, su richiesta scritta del Venditore, dovrà provvedere al pagamento del prezzo anteriormente alla messa in produzione dei Prodotti Contrattuali oppure, in alternativa, dovrà fornire idonee garanzie per l’adempimento (ad esempio fi deiussione bancaria o assicurativa). In mancanza di pagamento anticipato o di prestazione di idonea garanzia il Venditore potrà recedere dal contratto mediante comunicazione con raccomandata con ricevuta di ritorno. Nel caso il Compratore sia sottoposto a procedure concorsuali il Venditore potrà sospendere l’esecuzione del contratto di vendita mediante comunicazione scritta. 12.2 Il Compratore non può cedere, trasferire o altrimenti disporre delle presenti Condizioni Generali di Vendita, in tutto o in parte, a qualsiasi persona fi sica, società o ente, senza il previo consenso scritto del Venditore. 12.3 Le presenti Condizioni Generali di Vendita costituiscono abrogano e sostituiscono qualsiasi precedente accordo, scritto o verbale, intervenuto tra le parti sulla stessa materia. Eventuali modifi che o integrazioni al presente contratto dovranno essere fatte per iscritto e sottoscritte dai rappresentanti legali di ciascuna delle parti.

Art. 13 – Foro competente13.1 Qualsiasi controversia che dovesse sorgere tra le Parti concernente i contratti disciplinati dalle presenti Condizioni Generali di Vendita - comprese le controversie relative alla interpretazione, validità, esecuzione, risoluzione - sarà risolta dal competente tribunale di Torino (TO).

General conditions of sale

Art. 1 – RecitalsThe present General Conditions of Sale, having as object all products and accessories conceived and manufactured by Artekalor S.r.l. (hereinafter called “the Seller”) as well as the products manufactured by third parties and sold by the Seller, shall regulate all present and future contracts of sale between the Seller and the Purchaser provided that the Purchaser has its legal offi ce outside Italy.When the General Conditions apply to a specifi c contract, modifi cations or deviations from them must be agreed in writing.

Art. 2 – Purchase ordersThe purchase orders collected by the Seller or by its agents and commercial intermediaries become binding only when the Purchaser receives (by fax or by e-mail) the written acceptance (order confi rmation) from the Seller. In case of offer by the Seller, the offer becomes binding only when the Purchaser sends the express written acceptance to the Seller by order confi rmation. In this case the offer will have a validity of only 30 days from its confi rmation and will be ineffective after this date.

Art. 3 – PricesThe prices are those indicated in the price list as in force at the moment of the order acceptance. The prices are expressed in Euro and they are excluded from any national or foreign taxes, duties and expenses. The prices do not comprise any transport, postage or insurance costs related to the chosen Incoterm conditions. Any specifi c modifi cation of the products requested by the Purchaser shall be charged separately and added to the price offer.

Art. 4 – PaymentPayment terms are as stated in the Purchase Order Confi rmation. In the absence of such an indication, the purchase price must be paid in advance or on delivery and in the currency shown in the invoice. Any payments made to agents, representatives, or commercial intermediaries of the Seller shall not be deemed to have been carried out until the relevant sums are collected by the Seller. In case of late payment, the Seller will have right to the payment of any interests starting from the date in which the sum becomes collectible. The Seller will also have the right, after having notifi ed the Purchaser in writing, to suspend his performance of the contract until he receives the payment. If the Purchaser will not pay the owning amount within 30 days, the Seller will have the right, with previous written communication to the Purchaser, to terminate the contract and to obtain from the Purchaser the compensation of damages. In case of instalment payment, the lack of payment of even one rate will cause the loss of the respite of debt and will authorize the Seller to demand the immediate balance.

Art. 5 – Reservation of titleThe Products shall remain the property of the Seller until the complete payment of the purchase price. The Purchaser shall at the request of the Seller assist him in taking any necessary measures to protect the Seller’s title on his own Products. The retention of ownership will not impair the risk’s transfer as provided in art. 6 hereafter.

Art. 6 – Delivery6.1 The Seller will deliver the Products within the date indicated in the order confi rmation. If not specifi ed in the order confi rmation, the Seller shall supply the Products within 60 days from the date of order acceptance. Partial deliveries are admitted if not differently agreed.6.2 The Seller will not incur in any responsibility in case of shipment later than the term agreed with the Purchaser; therefore in case of delay in the goods delivery, no right to compensation of direct or indirect damages and/or to the termination of the Contract will be recognized from the Seller to the Purchaser, who renounces this right starting from now / however the Purchaser has the right to claim for damages and these damages can not exceed the maximum percentage of 1% (one percent) of the purchase price.6.3 The delivery of the Products is always considered executed with the communication that the goods are at Purchaser’s disposal, or that they have been delivered to the carrier for the transportation.

If not differently agreed in writing, the delivery shall be Ex-works (EXW) (ICC INCOTERMS 2010) in the place specifi ed in the purchase order confi rmation by the Seller, also in the case in which the Seller will organize the delivery. In this last case the Purchaser will incur any costs and the risks of the transport. 6.4 In case of no collection of goods at the agreed delivery date, the Purchaser shall pay the whole purchase price as if the collection has occurred. The Seller shall store the Products at the Purchaser’s risk and expenses.

Art. 7 – PackagingStandard packaging (carton, pallets) is used by Artekalor. In the case of special requirements related to the place of destination, Artekalor shall use special packaging.

Art. 8 – Claims and Warranty8.1 The Seller shall remedy to any defect, attributable to him, resulting from an error of project, defect of material or error of manufacturing that appear within a period of 24 (twenty four) months from delivery date. This guarantee does not apply if the Purchaser does not prove that he made a proper use, maintenance and storage of products, and that he has not modifi ed or repaired them without the consent of Seller. 8.2 The Purchaser shall notify in writing the Seller of any defect within 8 (eight) days of its discovery or immediately if the defect is so to cause damages. If the Purchaser does not notify the defect within the over mentioned term, the Purchaser loses his right to have the defect remedied. The notifi cation shall contain the description of the defect and have to be transmitted to the Seller by means of registered letter with return receipt. 8.3 On receipt of the registered letter, the Seller, once ascertained the claimed defects, is obliged under this guarantee to repair the defective Products or replace them. 8.4 The Seller may ask the return, at the Purchaser’s expenses, of the defected products that will become its property. In any case the return of products has to be previously accepted by the Seller. 8.5 If, after a test on the Product, the defect of the product does not depend on the Seller’s liability, the repair or replacement will be at the Purchaser’s charge, including all shipment’s costs. 8.6 The present warranty above provided is valid only if the Purchaser uses the Products in accordance with the indications set in the Seller’s catalogue and absorbs and supersedes any other legal guarantee for lack of compliance and excludes any other Seller’s liability. The Purchaser, in particular, shall have no right to claim damages, included loss of production, loss of profi t, loss of use, loss of contracts or for any consequential, economic or indirect loss whatsoever, reduction of price or termination of contracts.

Art. 9 – Drawings and descriptive documents 9.1 The size, capacity, prices, performances, colours, and the data contained in the illustrative documents of the Seller, as well as the characteristics of the samples and models sent by the Seller to the Purchaser, are to be considered approximate in nature. These data are binding only if they are specifi cally mentioned in the written acceptance of the Seller.9.2 Any design or technical document that allows the manufacture or assembly of the sold products or of their parts and is remitted to the Purchaser, either before or after the conclusion of the contract, remains of the exclusive property of the Seller. These drawings or documents cannot be used by the Purchaser or copied, reproduced or transmitted to third parties without the consent of the Seller. In case of breach of this clause, the Purchaser shall pay to the Seller the sum of 100.000,00 Euros plus 100,00 Euros for each day that such violation will continue, except the compensation of any major damage.

Art. 10 – Technical regulations and responsibility for damages caused by the ProductsThe Seller declares that the Products are manufactured following Italian legislation and technical regulation. The Seller, with the exception of its proved grave negligence, shall not be responsible for any damage to people or things caused by the Products. If the Seller will fall into these responsibilities, the Purchaser shall refund and defend the Seller.

Art. 11 – Force majeure and hardshipEach party shall be authorized from performing any of its obligations under this general sale conditions for a period no longer than 45 days due to the following circumstances: commercial disputes, events of Force Majeure, such as wars (both declared and undeclared) fi res, general military mobilisations, insurrections, seizures, requisitions, energy use restrictions, transport perturbations, strikes, lock out, stop of production due to technical causes, delays and defects in the delivery by suppliers and any other events which could not be expected, avoided and overcome.

If the event that the force majeure will last for more than 45 days, the other party shall be authorized to terminate the contract notifying the party facing this hindrance of such a termination by means of registered letter with return receipt. This latter part will not be obliged to compensate any damage in this case. If the performance of the obligation by the Seller has become excessively burdensome as to modify the contract for more than 20% (twenty per cent), the Seller shall have the right to demand the modifi cation of the contractual conditions or, to terminate the contract.

Art. 12 – Miscellaneous12.1 The Seller has the right to suspend the performance of its own services, in the presence of a change in the patrimonial conditions of the Purchaser that make think that this latter will not fulfi l its obligation of payment. In these cases, the Purchaser, on written Seller’s request, will pay the price before the starting up of the Contractual Products or, in alternative, will supply adequate guarantees for the performance (for example bank warranty or bank insurance). Failing the advance payment or any proper guarantee, the Seller could withdraw from the contract through a written communication by registered letter with return receipt. If the Purchaser is subjected to bankruptcy procedures, the Seller could suspend the execution of the sale contract by written communication. 12.2 These General Sale Conditions will not be transferable or assignable by the Purchaser without the express prior written consent by The Seller. 12.3 These General Sale Conditions supersedes all previous negotiations, agreements, commitments, written or verbal, between the parties and shall be released, discharged, changed or modifi ed only by instructions signed by the duly authorized representatives of each of the parties.

Art. 13 – Disputes and Applicable Law13.1 Any dispute relating to or in connection with these General Sale Conditions shall be fi nally settled by the competent court of Turin (TO), Italy. 13.2 These General Sale Conditions shall be regulated and interpreted in accordance with the United Nations Convention on Contracts for the International Sale of Goods (CISG) – Vienna 1980. All the aspects not provided for the above-mentioned Convention shall be regulated and interpreted in accordance with the Italian Law.

AVVERTENZE

È necessario eseguire accurati lavaggi a tutto l’impianto prima della messa in funzione al fi ne di togliere ogni residuo di lavorazione.Non collegare i radiatori all’impianto sanitario.Non utilizzare additive o liquidi protettivi.Non superare la pressione massima di esercizio riportata nelle specifi che di ogni singolo prodotto.Eseguire un accurate regolazione del detentore bilanciando così le portate ai singoli radiatori.È vietato tassativamente l’uso della canapa.Per la pulizia dei radiatori non utilizzare prodotti chimici che possono intaccare la superfi cie.Non bisogna assolutamente manomettere i radiatori elettrici perchè sono sigillati e riempiti con apposito liquido.È proibito provare la resistenza elettrica se non è sommersa, la si danneggerebbe irreparabilmente.Nel posizionare un radiatore seguire le istruzioni.In un radiatore a funzionamento misto elettrico raccomandare al cliente di non chiudere mai la valvola e il detentore perchè l’acqua in esso contenuta deve potersi espandere.Per cause di forza maggiore Artekalor può modifi care i processi produttivi in qualsiasi momento e senza preavviso alcuno senza che ciò comporti variazioni e/o sospensioni agli obblighi contrattuali o risoluzione dello stesso contratto.La perdita di carico che hanno i radiatori a confronto degli altri elementi che compongono l’impianto è da ritenersi ininfl uente ed accettabile.L’invio in qualsiasi forma di un ordine di acquisto, implicitamente accetta le condizioni generali di vendita nonchè le avvertenze sopra indicate.

MANUTENZIONE

Per la pulizia dei moduli utilizzare un panno umido e normale detergente.Non utilizzare spugne, detergenti abrasivi o corrosivi.Non utilizzare oggetti metallici o particolarmente duri che rovinerebbero la fi nitura dei moduli.Nel caso di acquisto del modulo nella versione lucida, lo stesso è spedito protetto da una pellicola trasparente che deve essere tolta solamente dopo l’assemblaggio. Per la particolarità di fi nitura della superfi cie lucida si raccomanda di pulire solamente con cotone idrofi lo imbevuto d’alcool. Si respinge ogni responsabilità di danneggiamento della superfi cie lucida se non sono rispettate le istruzioni.Quando in funzione, la parte esterna dell’apparecchio è calda.Se l’apparecchio non si scalda correttamente, verifi care che sia presente aria al suo interno. Effettuare lo sfi ato dell aria operando sull’apposita valvola.

ATTENZIONE

Quando si apre la valvola di sfi ato dell’aria “E” prestare attenzione ad eventuali schizzi d’acqua calda (~80° C) che potrebbero fuoriuscire. NON AVVICINARSI CON IL VISO.

It’s necessary to carry out an accurate washing of the installation in order to eliminate any manufacturing residuals.Do not connect the radiators to the sanitary installation.Do not use additives or protective liquids.Don’t exceed the maximum working pressure reported in the specifi cations of each single product.Please carry out an accurate regulation of the lockshield in order to balance the water deliveries to the single radiators.It’s forbidden the use of hemp.Don’t use chemical products to clean the radiators, they could corrode the surface.Please avoid tampering the electric radiators, because they are sealed and fi lled with a special liquid.It’s forbidden to test the electric immersion heater if not immersed, it may be irreparably damaged.Please follow the instructions when positioning a radiator.Please advise the customer never to close the valve and lockshield in ad electric mixed operated radiator. The water contained in the radiator must be able to expand.Owing to urgent reasons Artekalor may modify any time and without notice the production process without involving changes or/and suspensions of the contractual obligations or cancellation of the contract.The pressure loss of the radiators in comparison with other system elements is non-relevant and acceptable.The sending of a purchase order , in any form, to Hellos means that the above mentioned general sale and guarantee conditions have been read and accepted by the client.

MAINTENANCE

Use a damp cloth and normal detergents to clean the modules.Never use sponges or abrasive or corrosive detergentes.Never use metal objects or particulary hard objects which could ruin the fi nish on the modules.If you buy the shiny version module, it is wrapped in a protective trasparent fi lm, that must be removed only after the assembly. For the particolar fi nish of the shiny surface, it reccomend you to clean it only with cotton wool and alcohol. The company declines any responsability for any damages on the shiny surface, caused if you do not respect the instructions.The outside part of the appliance is hot while it is on.For the gloss paint version it is necessary to use POLISH or similar products, in this way the bright aspect remain perfect.If the appliance does not heat up correctly check there is no air inside.Bleed the air using the appropriate valve.

ATTENTION

Be aware that hot water (~80°C) could spray out when you open the “E” air bleed valve, so be careful. DO NOT PUT YOUR FACE NEAR IT.
