SVOLGIMENTO DELL’ASTAL’Asta si terrà in tornata unica .I lotti saranno aggiudicati al migliorofferente.La gara si svolgerà mediante offerte al rialzo, orali per alzata di mano,

mediante rialzi minimi dal 5% al 10% rispetto all’offerta precedente, aseconda dei lotti. Il banditore si riserva la facoltà di rifiutare offerteinferiori al prezzo di riserva.

RESPONSABILITA’Gli aggiudicatari sono responsabili dei propri lotti a partire dalmomento in cui l’aggiudicazione è stata pronunciata e dovrannoconseguentemente provvedere ad assicurare gli stessi I banditori nonpossono essere ritenuti responsabili per eventuali scomparse e/odeterioramenti. Dovranno smontare e caricare le macchine a caricoloro il 30 di giuono 2011 al più tardi, dopo l'aggiudicazione in accordocon TIFITESS. Il ritiro potrà essere effettuato solo dopo l’integralepagamento del prezzo e dei diritti d’Asta. Lo smontaggio dovrà esserefatto a regola d’arte, da personale qualificato e nel rispetto dellenorme sulla sicurezza sul lavoro. Eventuali danni cagionati a terzi, adaltri beni o ai locali durante le predette operazioni resteranno a caricodell’aggiudicatario.

GARANTEESThe participants in the auction could inspect the goods during thefixed dates. With his participation in the auction, the competingadmits to have inspected the goods, to have accepted them as theyare, and to want to buy them as “seen and approved”, without possibi-lity to claim. The technical information and the years of constructionare given for information only.

CARRYING OUT OF THE AUCTIONThe auction will be done in a single sitting. The lots will be adjudica-ted to the best bidder. The auction will be carried out through upwardoffers, in oral by show of hands, with minimum upwards from 5% to10% compared to the previous offer, depending on the lots. The auc-tioneers have the possibility to refuse offers which are lower than theminimum price which has been fixed.

RESPONSIBILITYThe purchasers are responsible for their lots as soon as the adjudica-tion is announced and, consequently, they will have to insure thegoods. The auctioneers cannot be considered responsible for possi-ble disappearances and/or deteriorations. The purchasers will have to dismantle and load the machines at theirown expenses on the 30 June 2011 at the latest, after the adjudicationin agreement with TIFITESS spinning plant.The collecting will be done only after complete payment of the priceand the auction fees. The dismantling must be made with care, bycompetent skilled staff, respecting all work safety rules. Eventualdamages done by third party to other goods or to the places duringthe above mentioned operations will be payable by the purchaser.

AUCTIONThe auction will be done in Italian language and will be subject to theItalian law. In case of claims about the translation of the notice text inother languages, the Italian text will be considered as prevalent.In case of translation, no claims will be accepted for mistakes andmisunderstandings.
