Gli ordini sono assunti “salvo approvazione della casa” e tale approvazione viene anche manifestata con la sola evasione degli stessi. Con il conferimento degli ordini si intendono accettate dal committente, senza riserve, le condizioni generali di seguito riportate.

1) I prodotti inclusi nei cataloghi sono di normale vendita. Agli stessi potranno essere apportate modifi-che e varianti al fine di migliorare la funzionalità. Le illustrazioni e le caratteristiche tecniche rappre-sentate nei cataloghi pertanto non sono vincolanti. Tutti i Riferimenti Originali sono di proprietà esclu-siva delle case produttrici.

2) I prezzi esposti nei listini non sono impegnativi, in quanto potranno essere aggiornati in qualunque momento, per intervenute variazioni dei relativi costi.

3) Gli ordini verranno evasi secondo la disponibilità del momento senza garanzie di saldo. Eventuali rimanenze saranno inviate appena disponibili, salvo che vengano annullate dal committente al rice-vimento della prima spedizione.

4) La merce viaggia a rischio e pericolo del committente anche se venduta Franco Fabbrica.

5) Il pagamento della fornitura deve esere effettuato esclusivamente presso la sede del venditore, con le modalità ed entro i termini stabiliti al perfezionamento del contratto di vendita. L’eventuale emis-sione di tratte o di ricevute bancarie non comporta deroga del luogo di pagamento. In caso di ritardato pagamento di una o più forniture decorreranno a carico del compratore gli inte-ressi secondo il tasso praticato dalle banche sugli scoperti di conto corrente. Il mancato o ritardato pagamento di una fornitura ci autorizza a ritenerci liberi da qualsiasi impegno e a ritenere annullati tutti i contratti di vendita in corso. Non sono accettati pagamenti con rimesse dirette. Per i nuovi clienti il pagamento dei primi ordini dovà avvenire esclusivamente con bonifico bancario anticipato o in contrassegno.

6) Resi per errata ordinazione od errata spedizione saranno accettati solo se giustificati ed effettuati entro 15 (quindici) giorni dalla consegna della merce, comunque, preventivamente autorizzati da RMS S.p.a. inviando una mail a [email protected]. Resi non precedentemente autorizzati dalla nostra Società o non accompagnati da documento di trasporto che deve recare gli estremi del nostro DDT o della ns. fattura di vendita non saranno accettati e di conseguenza saranno rinviati al mittente. I resi che NON rientrano nei termini qui sopra indicati (cioè oltre i 15 giorni dal ricevimento della merce) dovranno comunque essere autorizzati da RMS S.p.a. contattando [email protected].

7) Tutti i prodotti sono garantiti da regolare costruzione e funzionalità. L’eventuale restituzione di prodotti ritenuti difettosi dovrà essere preventivamente concordata con il venditore ed inviata in Porto Franco alla RMS S.p.a. I difetti lamentati dovranno essere specificati nella “ bolla di accompagnamento” a fianco dei singoli prodotti resi e saranno presi in esame esclusivamente se la bolla recherà anche i riferimenti delle forniture (numero e data delle fatture del venditore). Qualora venga accettatta la validità del reclamo la garanzia del venditore non andrà oltre l’accredito o la sostituzione dei prodot-ti stessi. I prodotti che invece risultassero non funzionanti per cause non imputabili alla loro qualità, bensì a seguito di manomissioni, rotture, errato montaggio, eccettera, saranno rispediti in porto asse-gnato al committente.

8) Al momento dell’ordinazione deve essere sempre precisato il codice articolo completo. Questo per-metterà una evasione del Vs. ordine in modo corretto. Se al posto del nostro codice articolo vi fosse una semplice descrizione, la RMS S.p.a. non si assume alcuna responsabilità per eventuali errori.

9) Per qualsiasi controversia relativa alla interpretazione o esecuzione delle suddette condizioni, viene accettata dalle parti la competenza esclusiva del foro di Milano.

Disegni e dati (descrizioni, caratteristiche, codifiche, prezzi ecc.) riportati su cataloghi e listini, possono es-sere soggetti a modifiche e variazioni. La rMS S.p.a. si riserva la facoltà di effettuare cambiamenti anche senza preavviso.

The orders we receive are accepted “unless the company does not accept them” and the acceptance is declared just with the preparation of the material. By sending the order, the customer automatically ac-cepts the following general conditions:

1) The products included in the catalogue are products sold normally by our company. To these pro ducts there can be the possibility of the application of changes and modifications in order to improve their usage. The photos, drawings and technical characteristics described in this catalogue are not at all binding.

2) The prices in the price list are to be considered not binding. They can be updated in every moment due to changes in the purchase prices.

3) The orders will be prepared according to the availability of the precise moment without any ensuring of the balance. The backorders will be sent to the customer with the following order unless they are deleted by the customer itself.

4) The material is shipped at risk of the customer as we are selling it ExWorks.

5) The payment should be done to the seller with conditions and terms previously decided. In case of any delayed payment there will be the extra charge of bank interests on the open amounts of debts on the bank account. The missed or delayed payment of just one invoice authorizes RMS s.p.a. to cancel all the selling contracts and commitments. For new customers we will accept only payment as advanced payment on proforma.

6) Warranty items will be accepted only when described and declared within 15 days from the de livery of the material, and they have anyway to be accepted and confirmed by RMS s.p.a. by sending a mail to [email protected] or by filling in the form on our website. Warranty items sent to us without delivery note and descriptions of the problems, and without references to the invoice number and date, will be rejected and sent back to the customer. The warranty items which are not included into the already mentioned terms shouldanyway be authorized by RMS s.p.a. by contacting [email protected]

7) All the products are guaranteed with correct quality and construction. The warranty items which has been authorized by RMS s.p.a. has to be sent free of charge to our storage. The defects and problems of the items should be mentioned on the delivery note traveling with the material sent back and they will be checked only if in the delivery note is mentioned also the date of invoice and number of the invoice. In case the warranty items will be accepted we will credit the value or substitute the items. All the products for which the damage is due to incorrect installation, breaking of parts after selling and tampering will be sent back to the customer at its costs.

8) While ordering there should me mentioned always the correct item code. This will allow us to prepare the order in a proper way. If there will just be a description of the item, RMS s.p.a. will not be responsible for any mistake.

9) For any dispute regarding interpretation and execution of the above mentioned conditions, the parties accept the exclusive competence of the court of Milan.

No photocopies are allowed and also any microchips, recording or else. The rights are reserved for all the countries in which we sell.

Drawing, data (descriptions, characteristics, codes, price and so on) that are described on price lists and catalogues can be subject to changes and modifications. rMS s.p.a. has the right to change any of these conditions without any advanced notice.
