It is hereby enacted as follows :-

1. (I) This Act may be called the Aligarh Muslim University Act, 1920.

(2) It shall conte into force on such date as the Governor-General in Couneil may, by notification in the Gazette of India, appoint.

2. In this A.ct, and in all Statutes made hereunder, unless there is anything repugnant in the subject or context,

(a) "Academic Council" means the Academic Council of the Uni- 1» versity;

(b) "Court" means the Court of. the University;

(c) "Executive Council" means the Executive Council of tnc Univer­sity;

5. Th.e Univer,ity .. haJJ have the following powers, namely :

(I) to prmHJ~,; for w"'t.ue'ion in such branches of learning as th-s Uni\cr~lly may tllirk fit, t1Dd to make provi:sion for research and for the nd•an.-vnent aud dissemination of knowledge;

(2) to prolllote Oriental and rstamic st .tdies and give instruction in Mu~!im theology and religion and to impart moral an<.i physical training;

(3) to hold examinations and to grant and cohfer dc!!recs and other academic dbt;nctions to and ou p~tsons who-- "'

(b) an: teachers in cdue:-.tional in'ltittrtions, unci« conditions laid down in tb~ Statutes and Ordinances, and $iUII have passed the cll.rominations of tbc University, tmd~r like cunditions:

(4) to confer honomry d::ei'CCS or otllt-'t distinctions on approved persons in the manner laid do·;:rn in the Statutes;

(5) to grant such diplomas to and to provide such lectures and instruc· tion for persons, not beinr; membi:r; of th.: University, ns the University may determine;

(6) to co-op::rate with other Universities and authoritit:s in such maruior and for such purposes as the University tnay dctermin~;

(7) to in~titute Professorship'S, Readerships, Lccturcnhip<t :lnd :my other teaching po:ts required by the University, and to appoint persons to such Professorships, Readerships, Lccturerships and posts;

(8) to institute and award Fellowships (including TrawllinJ Fellow· ships), Scholarships, Exhibitions and Prizes in accordance with the Sta~

tutes and the Ordinances;

(9) to institute· and maintain Halls for the residence of students of the University;

(10) to demand and receive such fees and other charges as may ~i.l

prescribed by the Ordinances;

(11) to su~rvis.: and control the resHlence and discipline of students of the University, and to make arrangements for promoting their health; and

( 12) to do all such other acts and things whether incidental to the powers aforesaid or not as may be requisite in order to further the obj~o-cts of the University as a teaching and examining body, to cultivate and pro-­mote arts, science and other branches of learning, including professional studies, technology, Islamic learning and Muslim theology, and to promote the interests of its students.

6. The degrees, diplomas and other academic distinctions ~ranted or onferred to or on persons by the University shall be recognised by the

Government as are the corresponding degrees, diplomas and other acad~­mic distinctions granted by any other University incorporated unJer any .:r.Jctme,t 7. The University shall invest and k'.:p iH;.::t:~cd in c;.•·cnrities in which trust funds may be invested in accorri:lnce with the law for the time bemg in force relating to trusts in British India a sum of thirty lakhs of rupees hS a permanent endowment to meet the recurring ch!lrgcs of the Univer· sity other than charges in respect of fellowships, Scholarships, Prizes .md rew:w.ls :

Provided that-

(a) of all permanent recurring grants of money whiCh have been made either to th~- Muhammadan Anglo-Oriental College, Aligarh, the ~L~lim t:ni\Cr\lly A~wciation or the Mu!>lim University Foundation Commmee, by an\ Ruler of a State in fndia; and

(hJ of the total income accrumg from immoveable properry (not bcmg land or buddin!''>. in the o..:cupation and use of the said C. '·~ge) \\hH..Il t>; th1. operation vfthis Act has been transferred to the L'ntv~··;,:v.

8. The L:ntvcrsrty shall, subject to the provisions of this Act and the Ordmancc~. be open to all persons of either sex and of whatewr race creed or d<1~, : · '

The Court sh.dl have power to make Statutes providing that mstruction in the .\lu~lim religion shall be compulsory in the ca~e of M U~>hm students.

10. Ev<.>ry student of the University shall reside either in a Hall or under wch conditions as may be prescrib~d by the Ordinances.

II. (!) All recognised teaching in connection with the Uuiversity courses 'hall be conducted by and in the name of the Universtt} and shall rndude lecturing, laboratory work and other teaching conducted in the Umver~tty by the teachers thereof in accordance with any syllabus pre:.cnbcd by Pcpufations.

(3} The authoritie~ responsible for organising such teaching shall be prescribed by the Statutes.

(4) The courses shall be prescribed by the Ordinances

(2) Wtth the approval of the Academic Council and the sanction of the Governor General in Council on the recommendation of the Visiting Board, and subject to such conditions as may be prescribed by the Statut~ and the Ordinances, the Univer!>ity may admit Intermediate coll~ges and schools in the Aligarh District to .such privilege:. of the University as it thinks fit.

13. (l) The Governor General shall be the Lord Rector of the Univer- ~

(4) The Court shall communicate through the Vice-Chancellor to tt·e > Lord Rector such action, if any, as it is proposed to take or has been (') taken upon the result of such inspertion or inquiry, ~

(5) Where the court does not. within reasonable time, take action to the satisfaction of the Lord Rector, the Lord Rector may, after consid,~r~ ing any explanation furnish~d or representation made by the Court ~~su<! such directions as he m~y think fit, abd the Court shall comply with such directions.

The Visiting Board . 14. (1) The Visiting Boanl of the University, if and when the Cnited Provinces of Agra and Oudti become a Governor's· Province wtthin the me~ning of the Government of lndia Act, shall consist of the GovcruM thereof, tltc members of the Executive Council. the lvtinistcrs, one memher nominated by the Governor und one member nominated by the Mmi~ter in charge of Education :

19. (1) The succc&!:.ors to the first Vice~Cbanccllor shall be elected by the Court from among its members. Every such election shall be ~ubjcct to the approval of the Governor-General in Council.

(2) The Vice-Chancellor shall exercise such pov.crs and perform such functions as may be prescribed by the Statutes.

20. (I) The Pro-Vice-Chancellor shaU be appointed by the Court. (2) He shall hold office for such term anJ with such power-. and

25. tutes. 26. The constitution, powers and duties of such other authorities as may be declared ~y the Statutes to be authorities of the University, shall

be prescribed bi the Statutes.

Statutes, Ordinances and Regulations

27 .. SubJect to the provisions of this 'i\ct, the statutes may provide for all or any of the following matters, namely :

(a) the conferment of honorary degrees and the appointment of

Rectors;

(b) the institution of Fellowships, Scholarships, Exhibitions, Medals and Prizes;

(c) t~e terms of office, and the method and conditions of appointment of the officers of the University;

(d) the designations and powerll of offkers of the University;

(e) the const1LUtion, powers and duties of the authorities of the L.ni­

\'ersity;

(f) the ctassificatio~ and mode of ar~ointrnent of teachers of the

University;

(g) the institution and maintenance of Halls;

{h) the c(m~titution of pro..,:uent m~d pension funds forth..: benefit of the o!llccrs, tcncher~ ;tn•l scrvunb of lhc 0niversity;

(i) the maintenance of a register of regi$terc:d grndu.1tes;

(j) the instruction of Muslim students in the Mu~fim religion nnd theology;

(k} the establishment of Intermediate colleges and schools; and

(I) all matters which by this Act are to be ot may be prescribed by Statutes.

28. {I) The first Statute:J are tho\e set out in the Schedule. (2) The first Statutes may be amended. repealed or added to by

Statutes made by the Court in the following manner :

(a) The Executive Counctl may propose to the CllUrt the draft of any Statutes to be passed by the Court. Su\..h dr~1ft :.hall be consider\.-d by the Court at its next meeting. The Court may approve such draft and pass the Statute. or may n:ject or return it to the Exe­cutive Council for re-consideratiOJ\, •!ithcr in whnle or in part, together with any amendments which the Court may suggest.

(b) The Executive Council shall not propose the draft of any Statute affecting the status, powers or constitution of any existing author­ity of the University until such authority has been given an oppor­tunity of expressing an opiPion upon the proposal. Any opinion so expressed shall be in writing and shall be cou~idered by the Court.

(c) No 'new Statute or amendment or repeal of an existing Statute shaH have any validity until it has been submitted throuJh the Visiting Board (which may record its opinion thereon) to the Governor-General in Council, and hus been approved by the latter, who may sanction, dhallow or remit it for further c,m­sideration :

Provided that no Statute dealing with the instruction of Muslim stu­dents in the Muslim teligion and theology shall require to be so "ubmitted or approved.

29. Subject to the provisions of this Act and the Statutes. f1e Ordin­ances may provide for all or any of the following malters, namely :

(g) the conditions under which women may be exempted from atten­dance at lectures and tutorial classes, and the prescription for them of sp~al courses of study;

(h) the fees to be charged for courses of study in the University and for admi~sion to the examinations, degrees and diplomas of the University;

(i) the maintenance of discipline among the students of the University.

(j) the management of any Intermediate cOlleges or schools main­tained by the· University and the supervision of any Intermediate colleges and schools admitted to privileges under section 12; and

(k} all matters which by this Act or the Statutes are to be or may be provided for by Ordinances.

30. (I) The Executive Council or, in academic Matters', the Acade­mic Council may make Ordinances.

(2) The firs.t vrdinances shall be framed as directed by the Governor­General in Council, and shall receive such previous approval as he may direct.

(3) No new Ordinance, or amendment- or repeal of an existing Ordin­ance ~hall have any· validity· until it has been submitted through the Court, and the Visiting Board (which may record its opinion thereon) to the Governor-General in Cou"ncil, and has obtaiaed the approval of the latter, who may sanction, disallow or remi-t it for furtht:r consideration.

(4) If any question arises between the Executive and the Academic Council as to which has the-power to make an Ordinance, either Council may represent the matter to the Visiting Board who shall refer the same to a tnbunal con.;i:.ting of three members, one of whom shall be nominated by the Executive Council, one by the Academic Council, and one shall be a Judge of a High Court nominated by the Lord Rector.

31. (I) The authorities of the University may make Regulations consistent w!th this Act, the Statutes and the Ordinances:

(a) laying down the procedure to be observed at their meetings and the number of members required to form a quorum;

(b) providing for all matters which by this Act, the Statutes or the Ordinances, arc to be prescribed by Rer;ulations; and

(c) providing for all other matters solely concerning such authorities or committees appointed by them not provided for by this Act. the Statutes and the Ordinances.

(2) Every authority of the University shall make Regulations providing for the giving of notice to the members of such authority of the dates of meetings aod of the business to be considered at meetings and for the keeping of a record of the proceedings of meetings. .

Admission and Examinations

32. {l} Admission of students to the University shall be made by an Admission Committee consisting of the Pro-Vii:e~Cha.ncellor, the Principal of an Intermediate College who shall be selected by the Vice-Chancellor and such other persons as may be appointed by the Academic Council.

(2) Students shall not be eligible for admission to a course of study for a degree unless they have passed the Intermediate Examination of an Indian University incorporated by any law for the time being in force, or an examination recognised in accordance with the provisions of this section as equivalent to the Intermediate Examination, and possess such further qualifications as may be prescribed by the Ordinances.

(3) The conditions under which students may be admitted to the diploma courses of the University shall be prescribed by the Ordi­nances.

(4) The University shall not, save with the previous sanction of the Governor-General in Council, recognise (for the purpose of admission to a course of study for a degree) as equivalent to its own degrees, any degree conferred by any other University or as equivalent to the Inter­mediate Examination of an Indian University. any examination conducted by any other authority.

(5) Notwithstanding anything contained in this Act or the Ordin· ances, any student of the Muhammadan Anglo-Orienta! College, Align.rh. who immediately before the commencement of this Act wa<; studying for any examination of the Allahabad University higher than the Intermediate Examination shall be permitted to complete his course in preparatiou thereof. The University shall provide for such <;tudents instruction in accordance with the prospectus of studies of the Ailahabad University and, notwithstandmg anythmg contained in the Indian University Act, 1904, any such students may be admitted to the examinations of that University, during a period not exceeding four years from the commencement of this Act.

33. (1) All arrangements for the conduct of Examinations made, and all examiners shall be appointed by the Academic

(3) The Academic Council shall elect its representatives nt its first meeting.

(4) Any member of the Court may be removed by a resolution, passed by a majority consisting of not less than two thirds of the members of the Courts to the effect that -

(i) he has become incapable of performing his duties; or

(ii) he has acted against the interests of the Umversity; or

(iii) he has been convicted by a Court of Law of what, in the opmion of the Court, is a serious offence.

10 (1) Every Foundation Mem~r of the Court shall, unless his office is previously vacated, hold office for five years fram the commencement of this Act.

(2) At the end of the fifth, sixth, seventh and eighth years after the commencement of this Act, as nearly as may be, one-fifth in number of the total number of the Foundation Members remaining at the end of the fifth year, shall in each of these years re>ign, and at the end of the ninth year all the Foundation Members then remaining shall resign.

(3) The order in which the Foundation Members shall resign shall be the .:everse order to which their names appear in the Annexure to this Schedule. '

(4) A foundation member who is required to retire under the provi­sions of the clause shall be eligible for election as an Ordinary Member in a vacancy occurring after his retirement.

11. (I) After the fifth and subsequent annual meetings up to the ninth, there shall be annually appointed in accordance with the provisions of clauses (2) to (5) of Class IV the following number of Ordinary Members, namely :

(vi\ publish and revise lists of prescribed and recommended books, if any, and prescribe syllabuses in consultation With the Department!> of Studies;

(vu) appornt a library committee wtth such powers as may be prescribed in the Ordinances; and

(viii) publish the University Gazette.

(2) All deci1>rons of the Academic Council as regards matters of discip­line of students, syllabuses of studies and the conduct of examinations shall be final, with the exception of those wbich relate to the Departments of Theology whose proceedings shall be subject to the approval of the Exe­cutive Council.

19. (I} There shall be Departments of Studies in the following branches.: uf knowledge, namely :

(i} English language and literature,

(li) Htstory and Political Science,

(iii) Economics.

(iv) Philosophy aDd Psychology.

(v) Physics.

(vt) Chemistry,

(Vii) Mathematics and Astronomy,

(viii) Geography,

(ix) Sunni Theology,

(x) Shia Theology,

(1i) IsbmH: Studi~.

("Uv) Urdu,

(v} Law. -• (2) As soon as circumstances permit, there shall also be Departments j· of Studies in the following branches of knowledge, namely :

(i) Education,

(ii) Botany,

(iii) Zoology,

(iv) Agriculture,

(v) Medicine,

(vi) Commerce,

(vii) Technology, and

(viii) such other departments as the Coun, on the recommendation of the Academic Council made through the Executive Counctl may institute. '

(3) Each Department of Studies shall-

(a) ~onsist of the teachers in the subject with which the Department rs concerned : provided that the Pro-Vice-Chancellor shall be an ex-officio member of each Department;

4 (b) have power to co-opt specialists not exceeding two in number

i·._·· except in the case of the Department of Law, which shaH co-op; . four members, two of whom shall be judges of a High Court;

(c) elect from among the Professors and Readers of the department its own_ Ch. airman w. ho shall hold office for three years, but must

25. Any member of the Court, the Executive Council, the Academic Council or any other ·university n.utholity or committee may resign by letter addressed to the Vice-Chancellor.

26. Every officer of the University and every member of any autho­rity whose term of office or membership has expired shall be eligible for re-appointment or re-election, as the case may be.
