Griglia di aspirazione in acciaio inox AISI 316. Motore elettrico asincrono a gabbia di scoiattolo in bagno d’olio atossico con grado di protezione IP68 in classe F. Versione monofase fino a 1,1 kW con protezione termoamperometrica e condensatore permanentemente inserito. PREzzI E TERMINI DI CONSEGNASalvo nostra deroga scritta, i nostri prezzi si intendono da listino in vigore, netti e per contanti, oltre IVA, per prodotti non imballati, franco fabbrica Varisco SpA – Padova, alla data convenuta. I termini di consegna sono forniti a titolo indicativo e come obbligazione di mezzi e non di risultato. I termini decorrono dalla conferma dell’ordine. Il superamento di detti termini non autorizza l’acquirente all’annullamento dell’ordine, né alla richiesta di un qualsivoglia risarcimento, compensazione, o pagamento di interessi. Ci riserviamo di effettuare consegne parziali. In caso di spedizione, la merce viaggia a spese, rischio e pericolo del destinatario anche se pattuita e/o spedita franco destino.

PAGAMENTISalvo nostra diversa indicazione, tutte le nostre fatture sono da pagarsi in contante presso la nostra sede di Padova, franco di ogni spesa e senza sconti. Eventuali reclami su fatture e note di addebito devono essere introdotti presso i nostri uffici entro e non oltre 8 giorni dalla data della fattura. Passato tale termine la relativa fattura sarà considerata come irrevocabilmente accettata.Non sono autorizzate ritenute né deduzioni, neanche in caso di reclamo in corso e per qualsiasi motivo questo sia stato introdotto.Ci riserviamo di effettuare la sospensione della consegna e di risolvere il contratto qualora ci pervenissero notizie tali da far dubitare della solvibilità dell’acquirente ed in tutti i casi in cui l’acquirente fosse in ritardo anche con una sola rata di pagamento di quanto a qualsiasi titolo dovutoci, senza necessità di messa in mora. In caso di ritardo nei pagamenti l’acquirente decadrà dal beneficio del termine e sulle somme scadute e non pagate decorreranno di pieno diritto e senza necessità di messa in mora gli interessi a ragione del tasso annuo della Banca Centrale Europea maggiorato di sette punti, salvo altri e maggiori nostri diritti.

RISERVA DI PROPRIETȦConserviamo la proprietà della merce fornita fino all’integrale ed effettivo pagamento della stessa. L’acquirente sopporterà tuttavia tutti i rischi relativi alla merce dal momento della consegna e in caso di smarrimento o distruzione resterà quindi debitore del prezzo convenuto. Qualora un terzo tenti di far valere un diritto sulla merce in questione l’acquirente dovrà comunicarcelo tempestivamente.

RECLAMIA pena di decadenza, eventuali reclami per differenze o mancanza di merce dovranno essere effettuati immediatamente al vettore nel documento di trasporto e a noi notificati per iscritto entro otto giorni dalla data di ricevimento dei prodotti o, qualora relativi a vizi non individuabili mediante un accurato e diligente controllo al momento del ricevimento della merce, entro otto giorni dalla scoperta. Non accettiamo resi salvo nostro previo accordo scritto.

GARANzIATutti i nostri prodotti sono garantiti per un periodo di 12 mesi dalla data della prima messa in servizio e comunque non oltre 18 mesi dalla data di consegna. Le riparazioni effettuate in garanzia non interrompono la decorrenza del periodo di garanzia. La garanzia concerne difetti di materiale e di lavorazione che compromettano il funzionamento del prodotto e lo rendano non idoneo all’uso al quale il prodotto è destinato, purché denunciati tempestivamente e comunque non oltre 2 giorni dalla loro scoperta. Sono esclusi i danneggiamenti derivanti dalle caratteristiche fisico/chimiche del liquido aspirato, così come i danneggiamenti delle parti che per natura o destinazione sono soggette a usura o a deterioramento, o che dipendono dal mancato rispetto delle nostre istruzioni d’uso o manutenzione, dal cattivo o inadeguato utilizzo o immagazzinamento del prodotto o da modifiche o riparazioni effettuate da personale da noi non espressamente autorizzato. La non identificabilità del n° di matricola è causa di esclusione della garanzia. La nostra prestazione di garanzia è tassativamente subordinata al fatto che l’acquirente abbia ottemperato a tutte le proprie obbligazioni maturate sino al giorno della richiesta ed a quelle scadenti nel corso del nostro intervento in garanzia. La decisione se emettere una nota di accredito, riparare o sostituire la merce, è presa a nostro insindacabile giudizio. Il rientro della merce può essere fatto solo se da noi autorizzato per iscritto, porto franco Varisco SpA - Padova. Tutte le spese di smontaggio/rimontaggio del prodotto dal/sul luogo di installazione ed ogni altro intervento su cantiere restano a carico dell’acquirente. La merce riparata o sostitutiva sarà riconsegnata all’acquirente franco fabbrica Varisco SpA - Padova. La merce sostituita diventa di nostra proprietà. È inteso che la suddetta garanzia è assorbente e sostitutiva delle garanzie o responsabilità previste per legge, ed esclude ogni altra nostra responsabilità (risarcimento del danno, mancato guadagno, campagne di ritiro, manodopera dell’acquirente, fermo cantiere, diminuzione del prezzo di vendita ecc.)

GIURISDIzIONEÈ esclusivamente competente il Foro di Padova ma ci riserviamo la facoltà di portare la controversia davanti al Giudice competente presso la sede dell’acquirente.

GENERAL TERMS OF SALE

ORDERSPlacing of orders for products or services implies that the purchaser accepts the present general terms of sale unconditionally and waives any claim to the application of the purchaser’s own general terms of purchase.

OFFERS AND DOCUMENTSThe offers issued by our agents or auxiliary personnel shall not be binding on our company until we have issued written confirmation of acceptance. Our catalogues, tables and other technical literature are supplied purely on a guideline basis.

PRICES AND TERMS OF DELIVERYExcept in the presence of our written derogation, our prices are taken from the price list in force at the time of the order, quoted net and for cash payment, net of VAT, for unpacked products, delivered ex works Varisco SpA – Padua, on the agreed date. Delivery dates are guideline and imply that we pledge to use our best efforts rather than constituting a guarantee of delivery. The terms are enforced from the date of order confirmation. If said terms are exceeded this shall not authorise the purchaser to cancel the order nor to demand any form of indemnity, compensation, or payment of interest. We reserve the right to make partial deliveries. In the case of shipment, the goods travel at the expense, risk and responsibility of the assignee, even if the contractual terms specify carriage paid terms.

PAYMENTUnless otherwise indicated by our company, all our invoices must be paid in cash at our Padua headquarters, net of all expenses and without discounts. Any queries in relation to invoices and debit notes must be sent to our offices no later than 8 days after the invoice date. Once this term has elapsed the relative invoice will be construed as having been irrevocably accepted.No withholding amounts or deductions are permitted, even in the case of ongoing claims and irrespective of the reason for such claims.We reserve the right to suspend deliveries and terminate the contract of sale if we should receive information such as to induce uncertainty of the solvency of the purchaser and in all cases in which the purchaser delays the settlement of even a single instalment of the agreed payment of the amounts due to our company for any whatsoever title, without any obligation on our part to place the purchaser in default. In the event of late payments the purchaser will automatically lose its entitlement to any extended payment terms and the outstanding amounts will become due immediately without notice of default, with interest at the annual rate of the Central European Bank increased by seven percentage points, without prejudice to our entitlement to claim other and higher amounts due to our company.

RETENTION OF OWNERSHIPOur company retains ownership of the goods supplied until the relative payment has been settled in full. Notwithstanding this clause, the purchaser will sustain all risks relative to the goods from the time of delivery, and therefore in the event of loss or destruction of the goods the purchaser will still be obliged to pay the agreed price in full. If any third party attempts to claim title to the goods in question the purchaser undertakes to inform our company of this situation immediately.

CLAIMSUnder penalty of forfeiture, any claims for differences or shortages of the goods must be made immediately to the shipping agent in the transport document and notified to our company in writing no later than eight days from the date of receipt of the products or, if relative to defects that are not evident by means of careful and diligent inspection at the time of reception of the goods, within the term of eight days from the time of discovery. No returns are accepted unless previously authorised in writing.

WARRANTYAll our products are guaranteed for 12 months from the date of commissioning and anyway for no more than 18 months from the date of delivery. Repairs carried out under warranty shall not affect the natural expiry of the warranty. The warranty covers defective materials or workmanship such that impair the proper operation of the product and make the product unfit for the use for which it is intended, provided such defects are reported promptly and no later than 2 days after they become evident. The warranty expressly excludes all damage deriving from the physical / chemical characteristics of the conveyed fluid and also damage of parts that, due to their nature or function, are subject to wear and deterioration, or defects that are caused by the inobservance of our operating and maintenance instructions, by negligent or inadequate use of storage of the product, or by modifications or repairs made by personnel who have not been expressly authorised by our company. Impossibility to identify the serial number of the product will automatically invalidate the warranty. Our warranty coverage is provided strictly on the condition that the purchaser observes all its obligations up to the date of the claim and the obligations that arise during our warranty intervention. The decision of whether to issue a credit note, repair the product, or replace it, will be taken at our sole discretion. Returns of goods are accepted only when such action has been authorised by our company in writing beforehand, with the goods shipped carriage paid to Varisco SpA - Padua. All expenses for dismantling/reassembly of the product at its place of installation and all other worksite interventions shall be borne entirely by the purchaser. Repaired or replacement products will be returned to the purchaser ex works Varisco SpA - Padua. Our company assumes ownership of the original products once they have been replaced. The foregoing warranty covers and replaces all statutory guarantees or responsibilities and waives any additional responsibility claimed of our company (compensation for damages, loss of earnings, recall campaigns, purchasers labour costs, worksite stoppages, reduction of sale price, etc.)

JURISDICTIONSole jurisdiction is assigned to the Law Court of Padua, although we reserve the right to bring any disputes before the competent judicial authorities at the domicile of the purchaser if we deem this action to be appropriate.
