Le seguenti condizioni generali di vendita formano parte integrante di ogni ordinazione anche se non ne viene fatta espressa menzione: l’accettazione integrale delle presenti clausole offerte da parte dell’acquirente presuppone la conoscenza esatta e l’accettazione senza eccezione alcuna.

PREZZII prezzi del presente listino sono espressi in euro e potranno essere modificati in qualunque momento senza preavviso. La Edilgreen si riserva la facoltà di modificare prezzi, condizioni generali di vendita e prodotti in qualsiasi momento e a suo insindacabile giudizio senza alcun obbligo di preavviso.

IVAL’IVA, l’eventuale imposta di registro, ed ogni altra imposta o tassa come qualsiasi altro onere fiscale che avesse a ripercuotersi sul prezzo sarà completamente a carico del committente.Se costui godesse di eventuali esenzioni o agevolazioni fiscali e tenuto a comunicarle per iscritto alla Edilgreen, all’atto dell’ordinazione con richiamo alla disposizione fiscale: in caso contrario Edilgreen assoggetterà la fattura alle normali imposte.

ORDINIGli ordinativi devono pervenire in Edilgreen tassativamente in forma scritta, possibilmente su nostro modulo d’ordine, e si intendono accettati solo al ricevimento della conferma d’ordine Edilgreen timbrata e firmata dal committente. Eventuali variazioni agli ordini confermati potranno essere accettate entro e non oltre tre giorni lavorativi dal ricevimento della conferma d’ordine Edilgreen.

TEMPI DI CONSEGNAI termini di consegna si intendono sempre approssimativi e mai essenziali e perentori, anche se pattuiti e solo relativi a giornate lavorative. Essi cominciano a decorrere dal ricevimento della conferma d’ordine Edilgreen timbrata e firmata dal committente per accettazione. La data di consegna fa riferimento alla settimana a meno che non venga fatta specifica richiesta. Si fa sempre riferimento alla data di partenza del materiale dai nostri stabilimenti.Il materiale verrà evaso in 20 giorni lavorativi dalla data del ricevimento della conferma dell’ordine.

SPEDIZIONILa merce viene resa franco nostri stabilimenti. A richiesta può essere resa franco destino con relativo addebito in fattura.La merce viaggia a pericolo del committente.Il destinatario è tenuto a controllare la merce in arrivo allo scarico. In presenza di eventuali imballi non integri si raccomanda lo scarico con riserva di controllo con timbro e firma della committente sul documento di trasporto.

CONSEGNE E PAGAMENTILe consegne potranno essere in qualsiasi momento annullate sospese o essere interrotte dalla Edilgreen, senza alcun obbligo di risarcimento danni se, a suo giudizio insindacabile, le referenze commerciali, economiche e finanziarie del committente, anche se pervenute successivamente all’inizio della fornitura, non offrano idonea garanzia per il buon fine della stessa.Non vengono accettate richieste di risarcimento danni per ritardi di consegna.I termini di pagamento vengono concordati direttamente dalla Edilgreen con il committente.Per ordini con un importo netto inferiore di euro 300,00 decadranno le condizioni di pagamento in essere e l’unica soluzione attuabile sarà il pagamento in contrassegno.Al verificarsi di un mancato pagamento nei termini concordati, tutti gli ordini in portafoglio saranno sospesi senza necessità di preavviso e ritenuti annullati per colpa della ditta acquirente, fatto salvo il risarcimento dei danni.

RECLAMI E SOSTITUZIONISi accettano eventuali reclami unicamente se fatti pervenire entro 8 giorni dalla data del ricevimento della merce.Eventuali resi di merce devono essere effettuati esclusivamente previa nostra autorizzazione e secondo le modalità che saranno concordate con il nostro responsabile al momento dell’autorizzazione al reso stesso.

ARTICOLII dati tecnici di questo catalogo sono soggette a tolleranze normali per lo stato dell’arte del prodotto, le misure specificate sono in millimetri e puramente nominali (generalmente arrotondate all’unità). Dati, foto, disegni e colori sono indicativi.

STATO DI SOLVIBILITÀAll’atto del conferimento dell’ordine (e ricevimento fattura) l’acquirente si dichiara in stato di solvibilità (art.461 c.p.)

CONTROVERSIEPer qualsiasi controversia sarà esclusivamente competente il foro di Treviso anche se il pagamento sia convenuto a mezzo tratta o cambiale domiciliata presso il debitore.

SALE CONDITIONS

The following sale conditions are an integral part of any order, also when they are not specifically mentioned. The buyer’s complete acceptance of the present clauses implies the exact knowledge and acceptance, with no exceptions.

PRICESThe prices listed here are expressed in Euros and can be modified at any time without notification. Edilgreen reserves the right to change prices, sale conditions and products at any time in its sole discretion without prior notice.

VATVAT, registration tax, and any other fee or tax incidence that may affect the price will fall upon the customer. If he enjoyes any exemptions or tax breaks, he is required to submit this to Edilgreen, in writing and referring to the tax provision, together with the order, otherwise Edilgreen will charge the invoice with normal tax.

ORDERSOrders must be submitted in writing, possibly on our order form, and will be accepted only on receipt of Edilgreen order confirmation stamped and signed by the customer. Any changes to already confirmed orders will be accepted no later than three working days from receipt of Edilgreen order confirmation.

DELIVERY TIMESDelivery times are always approximate and never essential and mandatory, even if agreed and only referring to working days. They begin from the receipt of Edilgreen order confirmation stamped and signed by the customer for acceptance. The delivery date refers to the week unless differently requested. It always refers to the departure date of the goods from our factories. The goods will be processed in 20 working days from the date of receipt of order confirmation.

SHIPPINGGoods are delivered EXW our factories. On request they can be delivered CIF our client with relevant bill.Goods travel at customer’s own risk.The customer is required to control the goods at discharge. In case of any damaged packaging, we recommend discharging subject to control with stamp and customer’s signature on DDT.

DELIVERY AND PAYMENTDeliveries can be cancelled, suspended or interrupted by Edilgreen at any time, without any indemnification if, in our final opinion, commercial, economic and financial customer’s references do not assure the success of the delivery, even if they are submitted after its beginning.We do not accept any compensation request for delay in delivery.The payment terms are agreed by Edilgreen together with the customer.For orders which payment amount is lower than 300,00 Euros, the normal payment conditions will lapse and the only workable solution will be a COD payment.If the payment is not fulfilled at the agreed terms, all the booked orders will be suspended without notification and cancelled because of the buyer, notwithstanding indemnification.

COMPLAINS AND SUBSTITUTIONSWe accept complains only if we receive them by 8 days from the date of receipt of the goods.Returns have to be done only upon our authorization and according to the agreement with our responsible.

ITEMSThe technical data of this catalogue are subject to normal tolerance for the state of the art of the product, the specified measures are in millimetres and strictly nominal (usually rounded up to the unit). Data, photos, drawings and colours are indicative.

SOLVENCYAt the moment of the order assignment and receipt of the bill the buyer is declared in state of solvency (art. 461 of the Penal Code)
