    The judges of the Tribunal will be headed by retired Malaysian Federal Court judge Tan Sri Dato Lamin bin Haji Mohd Yunus Lamin,

    who also served as an ad litem judge at the International Criminal Tribunal for the former Republic of Yugoslavia. The other judges in

    the Tribunal include notable names such as Mr Alfred Lambremont Webre, a Yale graduate, who authored several books on politics,

    Tunku Sofiah Jewa, practising lawyer and author of numerous publications on International Law, Prof Salleh Buang, former Federal

    Counsel in the Attorney-General Chambers and prominent author, Prof Emeritus Datuk Dr Shad Saleem Faruqi, prominent academic

    and professor of law, Michael Hourigan, an internationally renowned human rights lawyer and Prof Eric David, an International

    Humanitarian Law expert who was counsel at the International Court of Justice and the International Criminal Tribunal for Rwanda.

    The prosecution for the trial will be lead by Prof Gurdial S Nijar, prominent law professor and author of several law publications and Prof

    Francis Boyle, leading American professor, practitioner and advocate of international law, and assisted by a team of lawyers. The trial is

    open to the public and will be held on August 21-24, 2013

    The trial is open to the public and will be held on November 20-25, 2013 at the premises of the Kuala Lumpur Foundation to Criminalise

    War (KLFCW) at 2nd Floor, No. 88, Jalan Perdana, Taman Tasek Perdana, Kuala Lumpur.

    20 NovemberTribunal Hearing Against Israel and Yaron Begins

    Nella dichiarazione di apertura della procura il Prof Gurdial S. Nijar, ha affermato che questo processo

    significativo poich si accusa una nazione che sfugge alle risoluzioni delle Nazioni Unite, alle decisioni

    The Kuala Lumpur W ar Crimes Tribunal (KLWCT) commenced hearing of genocide and w ar crimes charges against the State

    of Israel and Amos Yaron, a retired Israeli army general today.

    In the prosecutions opening statement by Prof Gurdial S. Nijar, he stated that this trial is signif icant as it charges a nation that

    thum bs its nose at UN resolutions; decisions of the ICJ and shakes our confidence in the meaning of civi l isation.

    Prof Gurdial stated, that the prosecution intends to g ive incontrov ertible proof of th e incredible crimes conc eived since 1945

    and which sti l l contin ues unti l today. He stressed in his statement that for the Palestinians, it is a continuing tragic saga o f

    huge proportions. What they term as Nakba or catastrophe which started in 1948 with their forced dispos session and

    eviction from their homeland is a history of the present: an on-going disp ossession, dislocation, massacres, ethnic cleansing

    and all else. In short, the continuity o f the trauma is not just the result of 1948 but an on-going p rocess, and continuin g into

    the present and linked to curr ent Israeli polic ies and practices.

    He further added that it wil l show a gruesome tapestry of sus tained acts of ethnic cleansing, fol lowed where necessary by

    kil l ings, arrests, imprisonm ent without trial, torture, denial of adequate food, quantum of w ater, usurpation o f lands, incessant

    bomb ardment including b y phosphor ic bombs, which tear out the insides of human bodies upon co ntact and the siege and

    impriso nment of an entire nation and peoples: who are then subject to daily humil iation and impo ssible condit ion s of li fe.

    Such acts of evil represent a continuation of previous such acts. And they have not ceased since. They have further

    intensif ied and metamorphos ed into acts so grave as to fall within the ambit of the Genocide Convention.

    He further stressed that taken cumulatively they show th e establishment beyond doubt of th e crime of genocide; a pattern of a

    clear intent to kil l , injure and create impossible condit ion s of li fe designed to destroy the Palestinian populace, its spiri t and

    determination to survive as a people, as a nation.

    21 NovemberGaza War Victims Give Testimony

    L'accusa ha presentato testimoni diretti e famigliari che raccontano dell'Operazione Piombo Fuso - 27

    dicembre 2008 fino a met gennaio 2009- Israele lanci un massiccio assalto di 22 giorni sulla Striscia di

    morirono migliaia di Palestinesi, in gran parte civili, compresi i bambini.

    Mahmoud Al - Sammouni, di Gaza City, sopravvissuto, allepoca aveva solo 12 anni e vide suo padre

    The prosecution presented witnesses who related their o rdeals during Operation Cast Lead. On December 27, 2008 unti l mid

    January 2009, Israel launched Operation Cast Lead, a massive 22-day mil i tary assault on the Gaza Strip. The ferocity of the

    attack was unprecedented in the decades old con fl ict between the Israelis and the Palestinians, kil l ing thousands of

    Palestinian, mostly civi l ians includ ing children.

    16-year-old Mahmo ud A l-Sammo uni, one of the survivo rs of the attack in early January 2009, who w as only 12-years-old at the

    time of 2009 attacks, saw his father shot in c old blood by the Israeli soldiers.

    Mahmoud, a resident of Gaza City related that he and his friends were playing football around a fruit tree when they saw F16

    planes fly ing in th e area and droppin g bom bs and fir ing missi les. He further related that there were also many sold iers on th e

    ground s shooting at the walls of hom es as well as saw parachutists com ing down and landing on the highest buildings in the

    area and anyone who went ou t of their homes w ere shot dead.

    Displaying maturity b eyond his age, Mahmou d related the terrify ing or deal he and his family underwent dur ing the January

    2009 attacks. The soldiers wh ile shooting randomly at the family shot hi s 4-year-old brother tw ice in the chest and on ce in the

    head and four of hi s other brothers in their legs and behind th e ear.

    22 NovemberRenowned Historian Testifies on Systematic Ethnic Cleansing of Palestinians

    Il tribunale ha ascoltato la testimonianza informativa dal Dr Ang Swee Chai, consulente Royal London

    Hospital, in Inghilterra. A met agosto 1982, and a Beirut come consulente ortopedico e traumatologo

    The tribunal heard informative testimony fro m Dr An g Swee Chai, a consultant at the Royal London Hos pital, England. In mid -

    Augus t 1982, she came to Beirut as a Consultant Orth opaedic and Trauma Surgeon as p art of a Brit ish Medical Team sent by

    Brit ish Charity Christian Aid to Lebanon. []She gave a day-to-day account of her experiences from 15 to 22 September 1982.

    She informed the tribunal of fl ights of Israeli planes fly ing from the sea towards th e direction of the camps. The sounds of

    explosives and shell ing all around the area surrounding the Gaza Hospital, the wounded casualt ies, mostly w omen and

    children, pouring into th e hospital in increasingly large numbers, the hosti le environment wh en she and the other foreign

    medical personnel w ere escorted from th e Gaza Hospital, their polit ical aff i l iat ions and papers questioned and c hecked.

    She further testif ied that continuo us gunfir e as well as horrif ic screams of wom en and children could be heard from the

    direction of the camp and th at when the members of th e team finally returned to the Sabra and Shati l la camps in th e morning

    of 19 September, there were dead bod ies piled up everywhere, in some cases even whole famil ies wip ed out. By afternoon, the

    camps w ere sealed off to all medical teams by th e Lebanese tanks and troops. She also w itnessed 10-15 Israeli tanks driv ing

    away from th e scene.

    She testif ied that her medical colleagues wh o finally managed to get back into th e camp were escorted by Israelis and given a

    Hebrew pass and that the Palestinians sur vivors revealed to them that they cou ld not escape as the Israelis had sealed off the

    camps. She further added that the death toll as enumerated by the Lebanese Red Cross w as 2,400 on 22 September 1982.

    She said, I have read recent declassified release from the British National Archives, which put the death toll of the massacre

    as 3,500.

    University in Bethlehem was part of a peaceful student demonstration expr essing their dissatisfaction over the attacks

    launched by the Israeli troop s against Gaza City during th e previous w eeks. As he lay bleeding on the street, the Israeli

    soldiers refused to give him immediate aid instead took pictu res of him and m ade fun of him. The use of Dum Dum bullets

    during a m il i tary occupation is a war crim e and Nabil confirm ed that the usage of Dum Dum bullets were a norm i n the

    Palestine-Israeli con flict.

    Testimonianza dello storico israeliano Ilan Pappe/ Ilan Pappe testifies

    Ilan Pappe [n.d.r di Nuova Storiografia israeliana] ha testimoniato che le espulsioni non venivano decise

    ad hoc, come hanno sostenuto altri storici, ma costituivano pulizia etnica della Palestina in coerenza con

    basis, as other historians h ave argued, but co nstituted the ethnic c leansing of Palestine , inaccordance with Plan Dalet drawn up in 1947 by Israels leaders then.

    He testif ied that the expulsion of the Palestinians in 1948 constituted ethnic cleansing, as the

    Zionists m ovement was no t concerned w ith the native people. He revealed that it was as early

    as in the 1940s wh en the Zionists began deliberating the fate of the ind igenous peop le of

    Palestine and that th ey wanted to take over Palestine with as litt le Palestinians in it b y having

    them leave voluntari ly or be forced out.

    He further revealed that from 1948 unti l 1949, the plan was enforced b y Zionist for ces to cleanse vil lages and tow ns of

    Palestinians by encirc l ing the vil lages/towns from three flanks to intimid ate the residents into leaving by leaving one flank

    open. Some 530 vil lages were wiped out p hysically. Under the partit ion p lan, 56% of the land was to be handed to Israel

    wherein the 2/3 of the p opulation w as Palestinians. In the end, 93% of the land came und er the contr ol of Israel and 750,000

    Palestinians w ere left out as refugees in neighbo uring countries, in Gaza and West Bank. After the 1967 war, Gaza and West

    Bank were occupied.

    He added that having taken over m ost of Palestine territories, the Zionist policy c hanged from expell ing to destroying the

    Palestinians. Hence, the Sabra & Shati l la massacre was an attempt to destroy Palestinians in Lebanon.

    He told the tribunal that th e use of m il i tary action against Palestinians in Gaza and West Bank w as considered genocidal

    against people who cannot defend them selves. Mil i tary operations such as Summ er Rains, Autum n Clouds, and Cast Lead

    were just to kil l th e Palestinians and destroy the econom y, culture and their spiri t .

    In cross-examination b y Am icus Curiae Jason Kay, Prof Pappe agreed that his view of history is a m inority view and that wh ile

    he is grateful that the Zionist m ovement had saved his parents from the Nazi holocaust for w hich he is grateful however the

    moral w ay, is to live together with the Palestinians, not expel and kil l them.

    23 NovemberPrima Facie Case Established

    Nel controinterrogatorio, lAmicus curiae Larissa Cadd ha obiettato al dottor Walid Elkhatib il fatto che,

    durante la seconda Intifada, i Palestinesi avevano usato razzi verso Israele che hanno colpito i civili, e fra

    questi dei bambini. Ha anche suggerito che l'allora primo ministro Ariel Sharon, nel tentativo di pacificare

    si rec alla Moschea di Al Aqsa a Gerusalemme nel settembre 2000. Il dr. Elkhatib ha risposto che i razzi

    dei Palestinesi di Gaza non erano sofisticati come le armi israeliane e in quanto razzi artigianali non erano

    finalizzati a obiettivi specifici, nemmeno possedevano armamenti sofisticati come i carri armati e gli

    elicotteri. Ha detto inoltre che i Palestinesi non avevano motivo di credere che Ariel Sharon stesse

    tentando di fare pace con i Palestinesi.

    Sugli attacchi da parte dei Palestinesi, il P.M. Prof Gurdial nel suo riesame ha ribadito che gli israeliani

    On attacks by Palestinians, Prof Gurdial in hi s re-examination co nfirmed th at the Israelis dropped b ombs that targeted wom en

    and children kil l ing civi l ians d uring Op eration Cast Lead and that the Sabra and Shati l la massacre also in volved the Israelis.

    Riguardo al Muro, ha detto essere in realt una strategia per confiscare ed espropriare pi terra, perch

    non viene costruito sul confine ma all'interno della Cisgiordania. Ci sono al momento circa 730

    checkpoint e blocchi stradali in Cisgiordania, oltre ai " Checkpoint volanti", il che significa che gli israeliani

    possono comparire in qualsiasi luogo , in qualsiasi momento. L'esercito israeliano ai posti di blocco

    talvolta lascia transitare senza problemi, altre volte devono presentare unautorizzazione, altre i , devono

    aspettare ore in cosa, e un tragitto di un'ora pu richiederne cinque. Quando c' una manifestazione, i

    The prosecutions final witness was 42-year-old Jawwad Mus leh, a Christian Palestinian from West B ank who gave testimony

    of the repeated incidents of inc arceration that he had been subjected to si nce the age of 15 and gave the tribunal a clear

    picture of the socio-economic outlook o f West Bank. [...] He told the tribunal that more and more Palestinian lands are being

    taken away and that th ere are 700,000 Jewish settlers liv ing in the West Bank and in Jerusalem. Jerusalem, he said, is beingJudaised or Israelised.

    On the subject of th e Wall, he told the tribu nal, it is actually a strategy to c onfiscate and expropriate more land. He said that

    the wall is not built o n the border bu t inside the West Bank, and this has further reduced th e landmass of the West Bank.

    [...]He testified that there are at the moment some 730 checkpoints and roadblocks in the West Bank. This excludes flying

    checkpoints, which the Israelis set up at any place at any time. He related that the Israeli army contro l the checkpoints, at

    some checkpoi nts they can pass witho ut problem s, at some, they have to subm it ID, while at others, they have to wait for

    hours as they are very crow ded. He revealed that a journey of one hou r could take five hours. And w hen there is a

    demonstr ation, the checkpoints are simply shutd own.

    On the issue of w ater supply, he revealed that Palestinians suffer from water shortages as the Israeli authorit ies contr ol th e

    supply o f water. He testif ied that water is supplied to the Israeli sett lers at a cheaper price, and 5 times more in vo lume to

    Palestinians. He said that the water supplied to Palestinians is inadequate for their d aily use and causes them g reat hardship

    Parla il difensore Jason Kay in merito a quanto emerso nelle udienze precedenti-Sostiene che il genocidio

    richiede una diminuzione della popolazione del gruppo/vittima. Ha citato articolo 2 della Convenzione sul

    genocidio 1948 sottolineando che gli atti che costituiscono genocidio comprendono quelli commessi con

    l'intenzione di distruggere, in tutto o in parte, un gruppo nazionale, etico, razziale o religioso. Questo

    include uccidere i membri del gruppo, provocare gravi danni fisici o mentali , infliggere deliberatamente

    condizioni di vita intese a provocare la distruzione fisica, totale o parziale, imponendo misure intese a

    prevenire le nascite all'interno del gruppo e il trasferimento forzato di bambini a un altro gruppo.

    Pertanto, ha sottolineato che 'omicidio di massa' dovrebbe significare molte centinaia di migliaia e che

    l'omicidio di 3.000 persone, a Sabra e Chatila, non pu essere considerato abbattimento di massa, come

    lo fu di 800.000 persone in Ruanda in 100 giorni e l'uccisione sistematica degli ebrei dalla Germania

    -Sullaccusa contro Amos Yaron, Kay ha affermato che nessuno dei testimoni ha individuato Yaron in

    Unite.

    -Sul tema del Muro, Kay ha sostenuto che la recinzione stata motivata principalmente da considerazioni

    di sicurezza per proteggere le vite degli israeliani nella zona. La decisione di erigere la recinzione stata

    conseguenza dellaumento del terrorismo palestinese nel 2002. Con riferimento al Piano Dalet , Kay ha

    sostenuto non essere volto a pulizia etnica ma solo difensivo, ricordando che i Palestinesi sono

    sostenitori di Hamas, le cui azioni potrebbero essere considerate crimini contro l'umanit e crimini di

    guerra .

    Amic us Curiae Jason Kay submitted that genocide requires a decrease in popu lation of the victim/group. He quoted Artic le 2

    of the Genocide Convention 1948 pointing ou t that the acts that constitute genocide includes acts committed with intent to

    destroy, in whole or in part, a national, ethical, racial or religious group . This includes kil l ing m embers of the grou p, causing

    serious bodily or m ental harm to m embers of the group, deliberately infl ict ing on the group con dit ions of li fe calculated to

    bring about its ph ysical destruction in who le or in part, imposin g measures intended to prevent births within th e group, and

    forcibly transferring childr en of the group to anoth er group.

    He stressed that when one talks about massive killing it should mean many hundreds of thousand to millions. He submitted

    that the m urder of 3,000 people in the Sabra and Shati l la massacre could no t be con sidered massive kil l ing unlike i.e. the

    kil l ing of 800,000 people in Rwanda in 100 days and the systematic ki l l ing of the Jews by Nazi Germany.

    On the charge against Am os Yaron, the Amicus Curiae subm itted that none of the witnesses identif ied Yaron in any way as

    directly respons ible for the deaths that too k place in Sabra and Shati l la in September 1982. He argued that the Kahan

    Comm ission had cited that Yaron had told the Phalangists of the location of the terrorists in the camps and no t to harm the

    civi l ian population.

    With regard to Cast Lead Operation, the Amicus referred to the Israeli reports that di d not find any wron g doing o n the part of

    IDF. Also reference was made to Goldstones article that sa id that if h e had access to furth er evidence he would have had a

    different conclusion for the UN report prepared by him (Goldston e). On the subject of the Wall, the amicus submitted th at the

    In reference to Plan Dalet, the amicus su bmitted that the plan w as not aimed at ethnic c leansing and that it w as entirely

    LA SENTENZA - sintesi

    Il Tribunale dopo aver preso in considerazione, punto per punto, le argomentazioni della Difesa e

    rigettato, in particolare, il concetto che il genocidio sia una questione di numero delle vittime e

    ponendolo invece nellintenzione di distruggere in modo sistematico le condizioni di vita di un popolo,

    riconosce colpevole lo stato di Israele delle accuse che gli sono state mosse. Colpevoli, stato di Israele e

    generale Amos Yaron di complicit nell'uccisione di massa dei Profughi Palestinesi a Sabra e Chatila. Inparticolare per le argomentazioni della Difesa sul lancio di razzi palestinesi verso il territorio israeliano,

    che in alcuni casi hanno colpito dei civili, riconosce trattarsi di reazioni difensive agli attacchi dellesercito

    di Israele. Il Tribunale proceder a iscrivere Israele e il generale Yaron nel Registro dei Criminali di guerra

    e trasmetter gli atti del processo concluso alla Corte Penale internazionale. Raccomanda, inoltre, la
